New York. New York allows for wine shipments from 20 states. But it does not allow for wine and food to come in the same package.

Alaska, Florida, Idaho, New Hampshire. These states all allow wine shipments, but certain counties do not.

South Carolina, Texas, Arizona, Virginia, and New Mexico. These states all have limits on how much wine per year each person can receive ranging from 24 bottles per month, to 24 bottles per year. Amazon has a six bottle per purchase now. But maybe it could alter that for people coming from certain states. Wyoming has a limit of two cases per month, too. But Amazon for some reason worked it out with this state.

Louisiana. Wine buyers have to pay a sales tax and the shipper needs a permit.

As of 2011, it was legal to ship wine here, with an approval permit.

Of course, all of this might prove to complicated to make it worth Amazon’s while. It took Wine.com 10 years to turn cash positive, notes Bensinger, after getting fined by New York state for not following its rules and eventually going through bankruptcy. It might just make more sense to keep things simple.

Titled Wines Are No Longer Free to Travel Across State Lines, the piece detailed the intricacies of interstate wine shipping. Its conclusion? Consumers from all but 14 states can no longer legally ship wine across state lines.

The repercussions of this are enormous. Consumers in less prominent wine markets, such as Maryland or Montana, cannot access a wider range of top wines via wine clubs, online retailers, and out-of-state retailers. It also endangers wine retail shops that depend on out-of-state markets.

VinePair investigated what this really means for wine lovers across the country. Its complicated because shipping is not federally regulated, and individual state laws include variations and reciprocal agreements.

Get To The Bottom Of Wine Shipping

There 10 states that flat out dont allow wine to be shipped directly to you . What this image doesnt show you is that there are several states with additional rules and fees, making it hard for small wineries to deliver their wines to you. Lets look at some of the details on the archaic laws of wine shipping:

  • If you live in Alabama you have to get special prior written approval from the Alcohol Beverage Control Board and prepay for deliveries.
  • If you live in Utah youre a criminal if you bring more than 2 bottles of wine home from your travels.
  • If you live in Arizona or New Mexico you can only receive 2 cases of wine annually thats only one bottle every two weeks!
  • If you live in Colorado, Idaho, Louisiana, Montana, Nevada, South Carolina, Texas, Virginia, West Virginia and Wyoming, wineries must buy a yearly permit just to ship to you.
  • If you live in New Jersey large wineries cant ship you wine. No Gallo
  • If you live in California, Oregon, Washington, Alaska or Maryland you can pretty much get whatever you want, as long as they can get it to you.

Importing and exporting alcohol across country borders presents even more challenges. Youll now need to meet state, city, and country laws, as well as be familiar with exporting and importing laws.

Youll need to ensure that the distributor sending the shipment has the correct permits or the US government can seize your shipment. Youll also need to be aware of taxes and duties for international beer, spirit, and wine imports.

Amazon has launched an over the Internet wine sales operation, but don’t get too excited yet, most states still don’t allow shipping of alcohol to one’s front door.

Though certain states can maybe expect Amazon to expand shipments to their area, others will never-ever see shipments because of strict laws that prohibit wines being shipped from certain places and to certain other places. As you can see in that map to the right from the Wine Institute, the states in red prohibit the shipment of wine in some way or another. In Utah and Kentucky it is a felony, notes The Wall Street Journal‘s Greg Bensinger. People in Alabama need if they want to get wine, otherwise it’s illegal. But even in those blue states, there are some restrictions that might turn Amazon off from starting up business there. In West Virginia, for example, the winery has to get a letter of approval from its own state as well as West Virginia. Furthermore, advertising the shipment of wine to residents is illegal. However, there is some hope in other places.

How To Ship Whiskey

Shipping whiskey is no different than shipping wine or liquor. You will need a license, a special contract with UPS or FedEx, and you will only be able to ship it to people in states where it is legal to ship it to.

If you are shipping to a retailer, you may be required to pay some taxes or duties on it as well. Everything depends on where you are shipping the whiskey.

Why Interstate Wine Shipping Is So Complicated

Direct-to-Consumer alcohol shipping is governed by individual state regulations, and any person or business looking to legally ship wine needs a DTC license. For most alcohol retailers, the license is covered by their off-premise wine sales licenses. A California retailer, for example, can generally legally ship wine to residents of California.

If an out-of-state entity wants to obtain a license to legally ship wine to another state, however, it must apply for a separate, specific DTC license.

According to Alex Koral, industry relations advisor for ShipCompliant, a company that works with wineries to facilitate compliance, there are currently 42 states that offer out-of-state entities licenses to ship DTC in their states. Residents of Utah, Oklahoma, Delaware, Alabama, Mississippi, and Kentucky may not receive any DTC wine shipments, for the most part in Utah, non-compliance is actually a felony.

Wine shipping laws in the United States differ between states and are controlled by state law. While most alcohol sales are controlled by the three-tier system, nearly all states now permit some form of direct shipping of wine from wineries to consumers. Most states require wineries to pay for a permit in order to ship to consumers in the state, resulting in a winery-dependent slate of states that it may ship to. Direct wine shipments are also typically subject to sales and/or excise taxes. Most states also limit the quantity of wine that may be purchased monthly or annually, usually in terms of the number of nine-liter cases of wine that may be shipped, though most consumers are unaffected by these limits. Shipment of wine to dry areas is illegal.

In the 2005 case Granholm v. Heald, the Supreme Court ruled that states must regulate direct shipment of wines to consumers from in-state and out-of-state wineries in the same way, either allowing or banning both. Since that ruling, more states gradually began to allow direct shipment of wine from wineries to consumers. Some states also allow direct shipment of wine from out-of-state retailers to consumers.

How is wine defined?3-1-2 Wine means any alcoholic beverage containing not more than 24 percent alcohol by volume made from fruits, berries, or grapes either by natural fermentation or by natural fermentation with brandy added. The term includes, but is not limited to, all sparkling wines, champagnes, combinations of such beverages, vermouths, special natural wines, rectified wines, and like products.
