Illinois Winery Shipper’s Licenses

Under the three-tier licensing system for liquor licenses in Illinois, wine manufacturers must typically sell wine to distributors rather than to retailers or consumers. However, a wine maker may apply with the Illinois Liquor Control Commission for a Winery Shipper’s License that will allow the manufacturer to directly sell wine to Illinois residents who are at least 21 years old. Wine must be sold for personal consumption rather than for resale, and up to 12 cases of wine may be shipped per adult resident per year.

Prior to applying for a Winery Shipper’s License, a manufacturer must obtain a Federal Basic Permit, as well as a Certificate of Label Approval for all products being shipped to Illinois residents. If a manufacturer is located in Illinois, they must obtain the applicable state liquor license . Manufacturers outside of Illinois must obtain the applicable liquor manufacturer’s license in their home state.;

Can I Still Order Wine From An Out

In short, yes. In 2005, the;Supreme Court ruled;that states allowing in-state wineries to ship bottles DTC cannot prohibit out-of-state wineries from DTC shipping. Thus, states allowing in-state shipping from wineries must also allow interstate shipping from wineries, making DTC shipping much easier for wineries.

Retailers, on the other hand, have a much steeper hill to climb. Although 42 states currently;allow wineries to obtain DTC shipping licenses, only 10 of these states allow retailers to apply for these licenses. Three additional states California, New Mexico, and Idaho allow retailers to ship on a reciprocal agreement, meaning that if another state allows this states retailers to ship DTC, they will do the same. That leaves just 13 states that permit retailers to ship out of state.

Why This Is Happening Now

While it is true that the consumers residing in the states that do not permit out-of-state retailers to sell to their residents will no longer be able to order any alcohol from an out-of-state retailer, they technically have never been legally able to do so, Koral says.

Many retailers and wine clubs have been shipping wine across state lines for years, a practice that Koral noted has technically always been illegal. Recently increased pressure from state regulators is casting a spotlight on offenders.For instance, for years both FedEx and UPS have held policies stating that they only ship wine from licensed entities. Only in the past year have both have begun putting more effort into enforcing these policies. Now, carriers like FedEx and UPS will refuse to ship the wine, leaving many retailers no way to fulfill interstate orders.

Wine shipping laws in the United States differ between states and are controlled by state law. While most alcohol sales are controlled by the three-tier system, nearly all states now permit some form of direct shipping of wine from wineries to consumers. Most states require wineries to pay for a permit in order to ship to consumers in the state, resulting in a winery-dependent slate of states that it may ship to. Direct wine shipments are also typically subject to sales and/or excise taxes. Probably not. Because laws make it much easier for wineries to obtain DTC shipping licenses, consumers in most states shouldnt have issues with participating in winery-run wine clubs or purchasing wine to be shipped directly from a winery, both online and in person.

However, wineries typically have to apply and pay for licenses in each state to which they would like to ship, so Koral cautions that not all wineries may want to go through the effort of getting licensed in all 42 DTC states.

John Roska: Illinois Allows Only Wine Shipments From Out Of State

Q: Why are some businesses able to ship alcohol to Illinois, while others won’t? One online seller would ship hard liquor to Indiana, but not to Illinois. Why the differences?

A: Illinois permits out-of-state wineries to ship to Illinois consumers. It prohibits shipping beer or spirits into Illinois. So, you can only get wine shipments from an out-of-state winery.

The rarely used 21st Amendment actually applies here. In 1933, it repealed the 18th Amendment, which in 1920 had prohibited the “manufacture, sale, or transportation of intoxicating liquors” within the U.S.

While legalizing alcohol again, the 21st Amendment specifically permitted states to regulate the transportation of alcohol. Section 2 provides: “The transportation or importation into any State, Territory, or possession of the United States for delivery or use therein of intoxicating liquors, in violation of the laws thereof, is hereby prohibited.”

So, according to the 21st Amendment, any transportation or importation of alcohol into Illinois must comply with Illinois law.

In 2005, the U.S. Supreme Court said that if in-state wineries could sell directly to consumers, then out-of-state wineries must also be allowed to. State laws to the contrary were unconstitutional restrictions on interstate commerce.

That’s why only wine can be shipped into Illinois. And only from wineries not from just any retailer or online liquor store.
