Ten of these states require the retailer to receive a license, three operate under a reciprocal process, where only retailers located in those reciprocal states can ship to each others residents, and two states, Alaska and Florida, dont require a specific license. Except for selling to residents of these 14 states and D.C., it is illegal for a retailer to deliver beverage alcohol into any state in which it does not have a licensed retail operation.

Reciprocal Retailer Dtc States

Beyond the 10 license states and D.C., there are currently two states that operate under what is known as reciprocity rules. These states are California and New Mexico, which permit shipments of wine only.

These two reciprocity states allow out-of-state retailers to sell directly to their residents only if those out-of-state retailers are located in a state that allows out-of-state retailers to sell directly to their residents without any licensing, tax or other regulatory burdens. Put more simply, the rules in state B must be as free and open for retailer DtC sales as the rules in state A for a retailer shipping from state B to sell to a resident of state A. On June 22, 2016, Louisiana Governor Edwards signed legislation into law which will allow wineries holding a Direct Wine Shipper permit to ship wine directly to consumers in Louisiana, without requiring the consumer to visit the wineryas long as the wine has not been assigned to a Louisiana wholesaler.;The newly-signed law removes the existing restriction that prohibited any winery with a direct or indirect agreement with a licensed wholesaler in Louisiana from making any off-site DtC sales, a relatively new policy reported on in March. The legislation does not change rules for on-site DtC sales, though. The new rule will greatly expand Louisiana consumers choice in wines.

The legislation also replaces the current Louisiana Alcohol Tobacco Control direct shipper registration process with a requirement to obtain a Direct Wine Shipper permit. The ATC direct shipper permit fee for out-of-state wineries is $250, and for out-of-state retailers, $1000; these permits must be renewed annually. These new permit fees will provide funds for greater enforcement from ATC.

Out-of-state wineries must continue to register with the Louisiana Department of Revenue and pay the annual $150 registration fee.; The annual LDR registration fee for out-of-state retailers is reduced from $1,500 to $1,000.
