In short, yes. In 2005, the;Supreme Court ruled;that states allowing in-state wineries to ship bottles DTC cannot prohibit out-of-state wineries from DTC shipping. Thus, states allowing in-state shipping from wineries must also allow interstate shipping from wineries, making DTC shipping much easier for wineries.

Retailers, on the other hand, have a much steeper hill to climb. Although 42 states currently;allow wineries to obtain DTC shipping licenses, only 10 of these states allow retailers to apply for these licenses. Three additional states California, New Mexico, and Idaho allow retailers to ship on a reciprocal agreement, meaning that if another state allows this states retailers to ship DTC, they will do the same. That leaves just 13 states that permit retailers to ship out of state.

Retailers like Wine.com and national retail chains like Total Wine & More are not typically affected by DTC shipping restrictions because they have considerable resources. Total Wine & More, for instance, has brick-and-mortar stores across the U.S., all of which have in-state sales licenses with which they can ship wine orders. Online retailers without physical locations may have the ability to be present in states that do not allow DTC retailer shipping to get around these barriers, through local warehouses or retail partners.

Selecting A Delivery Date

We offer date-specific deliveries for most items purchased. A calendar with all available delivery dates will be presented to you after you enter your shipping address. Wine Shipping Laws In The United States

Wine shipping laws in the United States differ between states and are controlled by state law. While most alcohol sales are controlled by the three-tier system, nearly all states now permit some form of direct shipping of wine from wineries to consumers. Most states require wineries to pay for a permit in order to ship to consumers in the state, resulting in a winery-dependent slate of states that it may ship to. Direct wine shipments are also typically subject to sales and/or excise taxes. Most states also limit the quantity of wine that may be purchased monthly or annually, usually in terms of the number of nine-liter cases of wine that may be shipped, though most consumers are unaffected by these limits. Shipment of wine to dry areas is illegal.

In the 2005 case Granholm v. Heald, the Supreme Court ruled that states must regulate direct shipment of wines to consumers from in-state and out-of-state wineries in the same way, either allowing or banning both. Since that ruling, more states gradually began to allow direct shipment of wine from wineries to consumers. Some states also allow direct shipment of wine from out-of-state retailers to consumers.

What If I’m Not Home When My Shipping Order Arrives

Upon delivery, our delivery partners will ask to see the receivers ID to ensure they are 21 or older. The receiver will also be required to sign for the order. If you are unable to be home, we will make two additional attempts to deliver your order, and then it will be held at the shippers distribution center.

State Rules For Retailers Shipping Dtc

Nevada, Wyoming, Louisiana, Alaska, Connecticut, Florida and West Virginia permit the DtC sale of wine only for retailers. Nebraska, North Dakota, D.C. and New Hampshire permit the DtC sale of all types of beverage alcohol. Virginia permits the DtC sale of beer and wine, as does Oregon. However, Oregon only allows beer to come from states that themselves permit DtC shipping of beer.

Some other state considerations to be aware of include:

  • Alaska, West Virginia and New Hampshire have dry communities where it is illegal to sell alcohol in any manner, including DtC.
  • West Virginia and Virginia will require a DtC seller to indicate to the alcohol control boards which labels will be sold via DtC.
  • Virginia requires a retailer to post that they have permission from the manufacturer to resell their products through DtC, and also prohibits DtC sellers from using third-party marketing to advertise their DtC shipping option.

How To Ship Alcohol To Another State

When your booze crosses state borders, “you need to consider the laws for both the shipping state and the receiving state,” says Weinberg. So, for example, if you’d like to send a bottle of wine from a visit along Pennsylvania’s wine trail to a relative in Mississippi, don’t waste your time or your money. While it’s perfectly legal to mail wine from this northern state, it’s also perfectly illegal to receive wine shipments in Mississippi. In other words, Mississippi is not a reciprocal state, a state in which you can receive alcohol shipments from other states or countries, explains Lekkala. Of course, there’s an easy way around these convoluted laws, too. Mostthough not allalcohol that can be purchased in one state can be found somewhere in another, so if you’re dying to ship your brother a new brew, hit the web first to see if you can find a retailer in his state that carries the beverage, recommends Lekkala. It will be much easier to provide a credit card number over the phone than try to send that brew between states. “Even state-controlled stores realize they’re losing business to other states and improving the range of inventories they’re carrying,” Lekkala says.

Similarly to UPS, FedEx makes specific packaging requests of businesses shipping alcohol. Hereâs what to keep in mind:

  • Use polystyrene on the inside and cardboard on the outside. FedEx asks that spirits be shipped with these materials to be transported and delivered safely. It also mitigates temperature fluctuations, minimizes package shifting, and prevents spillage.
  • Avoid packing peanuts, packing paper, and cardboard partitions. Alcoholic beverages need specific kinds of packaging to prevent box damage. Cardboard partitions and packing peanuts donât keep beverage containers firmly situated enough, and packing paper can easily become unfurled.
  • Use directional arrows wisely. Directional arrow stickers are often added to fragile or directionally sensitive packages, but they canât always be honored by shipping carriers and 3PL companies. Instead, itâs best to put your shipping label on the top of the box, so truck drivers know which way is up if theyâre unable to find other stickers.
  • Reinforce your package with tape. Since a damaged beverage box can get messy fast, it never hurts to have extra layers of tape. After your box is sealed, put another layer on the bottom and top flaps, and double-check that the tape holds well.

Will Dtc Shipping For Retailers Expand In The Future

While there is a lot of interest among retailers and consumers for DtC shipping opportunities, the map for retailer DtC shipping map is a lot smaller than it is for other entities, particularly wineries. Part of the reason for this is the perception of unfair advantages that a remote retailer might have over local retailers, which leads to demands for laws restricting foreign competition. There is also concern among regulators that they lack the jurisdiction to properly monitor and control retailers located in other states. However, the general success of retailer shipping in the states that do allow it would seem to belie these concerns.

Another issue currently facing the retailer DtC shipping market is the lack of a national policy on whether states can extend discriminatory permissions for local retailers to do DtC shipping, while blocking that permission for remote retailers. The 2005 Supreme Court case Granholm v. Heald established the modern jurisprudence around DtC shipping of alcohol, primarily that states could not allow local shipping of wine while prohibiting it from out-of-state sources. However, that case only mentioned producers and it left open the question of retailers. There have been efforts over the years to extend Granholm to retailers, but they have been unsuccessful so far and even faced increasing pushback in just the last year or two.
