Are There Different Regulations For Each State

As we mentioned earlier, 44 states allow the delivery of alcohol. Each state has slightly different rules and regulations in regards to delivery service and sales. While we wont waste time by going through all 44, we will discuss ten states with varying rules to highlight their differences and similarities.

  • Alaska: Alaska is very relaxed with its delivery laws, but there are different regulations that vary by city and county.
  • Arizona: While this state is now also very relaxed, they werent always. Since 2017, they removed a rule which placed a limit on the number of bottles that distributors could send to consumers, which made things much easier.
  • California: It comes as no surprise that the huge state of California has the largest market for alcohol delivery in the country. Even with in-state fulfillment, the laws are extremely relaxed.
  • Florida: Similarly to California, Florida also has very relaxed laws regarding delivery. They are also in the top five states for having one of the largest markets.
  • Minnesota: This state is a bit stricter with its delivery laws. They limit the number of permitted sales for alcohol with companies and distributors that can ship directly to residents.
  • Missouri: The laws in Missouri are complex and a bit strict. For example, they allow in-state shipments of alcohol but do not allow out of state distributors to ship alcohol to its residents.

Wine Shipping Laws In The United States

Vintage Wine Estates Curtis Stone Wine Selections 3Bottl…

Wine shipping laws in the United States differ between states and are controlled by state law. While most alcohol sales are controlled by the three-tier system, nearly all states now permit some form of direct shipping of wine from wineries to consumers. Most states require wineries to pay for a permit in order to ship to consumers in the state, resulting in a winery-dependent slate of states that it may ship to. Direct wine shipments are also typically subject to sales and/or excise taxes. Most states also limit the quantity of wine that may be purchased monthly or annually, usually in terms of the number of nine-liter cases of wine that may be shipped, though most consumers are unaffected by these limits. Shipment of wine to dry areas is illegal.

In the 2005 case Granholm v. Heald, the Supreme Court ruled that states must regulate direct shipment of wines to consumers from in-state and out-of-state wineries in the same way, either allowing or banning both. Since that ruling, more states gradually began to allow direct shipment of wine from wineries to consumers. Some states also allow direct shipment of wine from out-of-state retailers to consumers.

    MADISON, Miss.

The Department of Revenue said the state of Mississippi is now in the alcohol delivery business. About a dozen companies have a license to deliver alcohol ordered from a liquor store to homes.

Raj Ramaraos Moonshine Mississippi business is taking orders. Customers order their liquor online and Ramaraos drivers pick it up at the store and deliver it to their front door. Customers have to scan their ID to confirm they are of age.

Ramarao said about half-a-dozen drivers are ready to go, with more to follow as his business grows.

“As of today, you can get your food delivered to your home, your groceries and even your coffee. A lot of places, so why not alcohol?” Ramarao said.

Madison Cellars is one of the liquor stores now accepting those orders. Pete Clark said there are some unknowns with his new addition to the alcohol sales industry, but not in what it might offer customers.

“It is the convenience. Our customers, some are going to be too busy to get here, especially during the holidays, or they forgot and need a bottle of this, or a bottle of that,” Clark said. “Why not have it delivered, and they dont have to make that extra trip.”
