There 10 states that flat out dont allow wine to be shipped directly to you . What this image doesnt show you is that there are several states with additional rules and fees, making it hard for small wineries to deliver their wines to you. Lets look at some of the details on the archaic laws of wine shipping:
- If you live in Alabama you have to get special prior written approval from the Alcohol Beverage Control Board and prepay for deliveries.
- If you live in Utah youre a criminal if you bring more than 2 bottles of wine home from your travels.
- If you live in Arizona or New Mexico you can only receive 2 cases of wine annually thats only one bottle every two weeks!
- If you live in Colorado, Idaho, Louisiana, Montana, Nevada, South Carolina, Texas, Virginia, West Virginia and Wyoming, wineries must buy a yearly permit just to ship to you.
- If you live in New Jersey large wineries cant ship you wine. No Gallo
- If you live in California, Oregon, Washington, Alaska or Maryland you can pretty much get whatever you want, as long as they can get it to you.
Shipping Beer Liquor And Wine With Ups
UPS allows direct-to-consumer alcohol shipment, with a number of strict rules. You can find all the UPS rules and regulations on the UPS Wine & Alcoholic Beverage Program page.
UPS alcohol shipment rules include:
- You have a UPS account number
- You have signed an alcohol shipping agreement contact with UPS
- You have a federal license to ship alcohol
- You have the correct permits to ship alcohol in the states your sending to
- You must follow the guidelines set in both the sending and receivers state
- You must use inner packaging of EPS foam or molded fiber tray
- You must package the alcohol in the center of the shipment, away from the packages sides
- Your package must be deemed sturdy by UPS
- You must clearly label the shipment and meet UPS, origin state, and destination state guidelines
- You must clearly label the package as containing alcohol
- You must receive a signature upon delivery from an adult that is 21 or older

Can you — legally — ship wine to your friends for the holidays? Just like last year, it depends on where they live.
The U.S. Supreme Court didn’t exactly force open a door for direct shipping of wine with its May ruling on the issue. Instead, it nudged 50 different doors: some swung open, some slammed shut and many remain confusingly ajar.
Wine shipping regulations continue to vary by state. Moreover, while several states created new laws this year that allow California wineries to ship directly to their residents, some added regulations to discourage it.
“Some states, it’s just not worth it,” says Jennifer Tensley, director of operations for Tensley Wines in Santa Barbara County. “The paperwork for Texas and New York isn’t too difficult. Connecticut is like a book. Plus, they want quarterly reporting. We’re not shipping to Connecticut.”
Now here’s a different question: Can you ship wine to your friends, regardless of where in the United States they live?
The answer seems to be yes. As an experiment, two bottles of wine each were shipped last week to people in Florida, New Jersey and Tennessee — all states to which such shipping is not completely legal.
No one rejected the packages, and the wines arrived without incident in all three states.

UPS spokesman Norman Black cautions that if a law was broken, the sender is the one responsible — not the delivery driver.

That is what we usually do, but with all the new fee’s I thought mailing might be less costly 🙂
But, if you think about the time and money expended to ship it? Ferget it, not worth it.
Just relax and pay the price at home, a bottle of booze lasts a long time and still is cheap compared to bar prices

Nevada Restricts Residents Rights To Receive Dtc Shipments Of Alcohol
Earlier this year, SB 307 was enacted in Nevada, effectively eliminating the right for Nevada residents to receive direct-to-consumer shipments of beer and spirits from producers, or any alcoholic beverage from out-of-state retailers.
Previously, Nevada DtC alcohol shipping permissions were among the most open, with the state allowing breweries, distilleries and retailers to sell and ship their products directly to Nevadans. In this move, however, the government has determined its residents should be denied access to broad swaths of the national beverage alcohol market.
Notably, though, the permissions for DtC shipping of wine by wine suppliers remain in effect, so Nevada residents can continue to enjoy that market.
Interpreting Nevadas DtC alcohol shipping laws has never been that straightforward. The rules, found in NRS 369.490, are derived from the states personal importation laws, which set out when and how Nevada residents can carry in limited quantities of alcoholic beverages when they return home from out of state. Under those laws, there has historically been permission for the Nevada residents to both remotely submit an order for alcohol and to have the alcohol shipped back to their home through a third-party carrier. Other chapters in the Nevada statutes then set out the broader compliance requirements that vendors selling and shipping under those provisions would have to abide by, including getting the necessary licenses and paying state taxes.

Can I Still Order Wine From An Out
In short, yes. In 2005, the Supreme Court ruled that states allowing in-state wineries to ship bottles DTC cannot prohibit out-of-state wineries from DTC shipping. Thus, states allowing in-state shipping from wineries must also allow interstate shipping from wineries, making DTC shipping much easier for wineries.
Retailers, on the other hand, have a much steeper hill to climb. Although 42 states currently allow wineries to obtain DTC shipping licenses, only 10 of these states allow retailers to apply for these licenses. Three additional states California, New Mexico, and Idaho allow retailers to ship on a reciprocal agreement, meaning that if another state allows this states retailers to ship DTC, they will do the same. That leaves just 13 states that permit retailers to ship out of state.
The Truth Behind Dtc Shipping Of Alcohol
This does align Nevada with most other states in allowing DtC shipping of wine only by wine producers. However, it is a disappointing reversal of recent trends to establish a broader market for DtC shipping of all alcoholic beverages. Surveys consistently find that consumers increasingly want greater access to DtC shipped alcohol and are frustrated with laws that restrict that access. That a state would reverse course and determine to shut down an existing market should be upsetting to those residents who had previously enjoyed its benefits.
Years of experience with the DtC wine shipping demonstrate that it is a healthy and safe market, with a broad commitment to compliance by those engaged in it, and which can be very lucrative to both the sellers and states . By providing an alternative route, DtC shipping enables consumers to access a vastly expanded list of available alcoholic beverages, primarily those small-batch or highly allocated products that generally cannot get the attention of wholesalers for distribution in a states three-tier system.
However, that safe, compliant market can only exist where states enable it to exist by enacting laws that establish a venue for legal DtC shipping. Historyespecially the so-called great experiment of Prohibitionshows that making sales does not eliminate those sales, but instead shoves them into dark corners where only those who are already happy to break laws can profit.

A 2017 New York Times article sent nation-wide ripples across the wine connoisseur community with a conclusion that only 14 states allowed for cross-state wine shipping. However, the legislators have amended some of the regulations by late 2018.
For example, direct shipping has been legal in Oklahoma since October 2018. The carriers and wineries need to follow in-state reporting procedures and pay special taxes. The New York state legislation is unique in that it requires a winerys home state to have similar direct shipping laws as the state of New York itself.

When your booze crosses state borders, “you need to consider the laws for both the shipping state and the receiving state,” says Weinberg. So, for example, if you’d like to send a bottle of wine from a visit along Pennsylvania’s wine trail to a relative in Mississippi, don’t waste your time or your money. While it’s perfectly legal to mail wine from this northern state, it’s also perfectly illegal to receive wine shipments in Mississippi. In other words, Mississippi is not a reciprocal state, a state in which you can receive alcohol shipments from other states or countries, explains Lekkala. Of course, there’s an easy way around these convoluted laws, too. Mostthough not allalcohol that can be purchased in one state can be found somewhere in another, so if you’re dying to ship your brother a new brew, hit the web first to see if you can find a retailer in his state that carries the beverage, recommends Lekkala. It will be much easier to provide a credit card number over the phone than try to send that brew between states. “Even state-controlled stores realize they’re losing business to other states and improving the range of inventories they’re carrying,” Lekkala says.

Direct-to-Consumer alcohol shipping is governed by individual state regulations, and any person or business looking to legally ship wine needs a DTC license.
