4. Review and comply with the following shipping requirements:

  • Use of an electronic shipping solution. For U.S. alcohol shipments, you must create your shipping label using an up-to-date FedEx Ship Manager® electronic shipping solution or a FedEx-approved third-party system. Airbills are not permitted. You must identify all alcohol shipments by selecting the alcohol checkbox on your shipping software. For international alcohol shipments, you may use the FedEx International Air Waybill®, but use of a FedEx Ship Manager solution is encouraged.

Because liquor is an alcoholic beverage, it is subject to the same strict shipping requirements that wine is subject to. This means that you will have to obtain a license to ship it, get a special contract with UPS or FedEx, and only ship it to states where you can legally ship it to.

Overview

Only FedEx-approved, licensed alcohol shippers that have entered into a FedEx Alcohol Shipping Agreement may ship alcohol via FedEx services. Consumers may not ship alcohol of any type via FedEx services.

Licensee-to-licensee in the U.S.

The shipper must be a FedEx-approved alcohol shipper, the recipient must be a business entity that holds appropriate alcohol licenses, and the shipment must otherwise comply with applicable laws. Shipments can move via FedEx Express®, FedEx Ground®, or FedEx Home Delivery® services.

Licensee-to-consumer in the U.S.

FedEx only transports wine licensee-to-consumer. Direct-to-consumer wine shipments are limited to the destination states outlined in the Direct-to-Consumer Reference Guide and must otherwise comply with applicable law.

Licensee or consumer designation in FedEx automation*

Shippers are required to use updated versions of FedEx automation for shipments containing alcohol. In doing so, FedEx requires shippers to designate whether an alcohol shipment is intended for a “Licensee” or a “Consumer”.

Shippers should select the “Consumer” designation for wine shipped directly to an individual consumer for personal consumption regardless of whether the shipment is destined for a residential or commercial address. All shipments designated as “Consumer” shipments must comply with all applicable laws and regulations.

Wisconsin Direct Shipping Bill Receives Governor’s Signature

Senate Bill 485 was passed into law yesterday, making Wisconsin the newest addition to the list of permit states. Wisconsin was one of the three remaining states that had yet to change their direct shipping laws since the Granholm ruling. Direct shipping law did not authorize intra-state shipments of wine to consumers, and the reciprocity agreement defined by Wisconsin only allowed California wineries to ship directly to the states residents. Now, a winery in any state may ship wine directly to a Wisconsin resident once the winery has received a direct wine shipper permit from Wisconsin.

The new direct wine shippers permit allows licensees to ship wine directly to an of-age and non-intoxicated individual in Wisconsin. The individual may receive no more than 108 liters of wine annually from any combination of licensees. The individual is responsible for compliance with this annual limit. The fee for this permit is no more than $100/year. Sales tax, excise tax and reporting are required quarterly.

This is good news for direct to consumer sales no capacity caps, no touchy age-validation restrictions but theres a catch concerning self-distribution: all sales to retailers must go through a wholesaler.

Luckily, there are a couple safeguards for small manufacturers.

All wholesalers must work diligently to ensure that distribution channels are available for the sale of intoxicating liquor products through wholesalers to retailers in this state.
