Only 14 States Legally Allow Buyers To Have Wine Shipped From Retailers In Other States

HOW TO SHIP / MAIL BEER (alcohol, wine, moonshine) | Homebrew 4 Life

The once largely-ignored regulations for interstate wine shipping have seen their enforcement ramped up in recent years.

The internet has changed commerce in innumerable ways. Look no further than major retailer compared to brick-and-mortar decline. But just as some companies are ahead of the curve and some are behind, the law and law enforcement have also struggled to keep up with the ramifications of changing technology, creatingor alteringlegal gray areas. Interstate wine shipments fit into this category. At first, being able to buy wine from across the country at the click of a button seemed like a wine drinkers dream, but as the New York Times recently discussed, for now, the opening of that Pandoras box has actually made interstate wine sales more difficult than ever before.

Alaska, California, Idaho, Louisiana, Missouri, Nebraska, Nevada, New Hampshire, New Mexico, North Dakota, Oregon, Virginia, Washington, D.C., West Virginia and Wyoming: Those are the only 14 states that allow wine to be shipped to consumers from out-of-state retailers, according to the Times. .

Wholesalers have been looking at this issue for quite some time, Daniel Posner, president of the National Association of Wine Retailers, told the paper. They went to state liquor authorities and said, People arent following the laws. Now its all coming to a brutal end.

Driving By A Vineyard In November I Noticed Grapes Still Hanging Under Netting Didnt Wineries Already Harvest Their Grapes By Then

Yes, harvest has ended for traditional wines. The grapes still seen on the vine are most likely sweetening up to create what wineries call late-harvest wines. These wines, aptly named because of the delayed harvest, are typically rich with flavors of honey and often, tropical aromas. Waiting for these delicious grapes to further ripen on the vine is a risky proposition the birds and deer love the grapes even more the sweeter they get!

How To Ship Wine: General Overview

First of all, the;most important thing to keep in mind is that its illegal for one individual to ship any amount of wine to another person through the mail in the United States, regardless of where you live or whether you try the U.S. Postal Service, UPS, or FedEx.

That doesnt mean you cant send wine to someone but you cant just stuff it in a box and slap a few stamps on it. Unless youre willing to take a big risk and break the law, to ship;wine you need to buy it from a company whos;certified to deliver it. The good news is, plenty of companies are licensed to ship wine to most states.;

Depending on the quantity youre sending and where its going, there could be additional hurdles to overcome. For instance, if you want to send wine to a friend in Oklahoma, youre out of luck: The Sooner State doesnt allow it, and you might be looking at a felony if you get caught trying.

While the law is mostly the same in Delaware, theres one important loophole: If youre a resident of Delaware and youre visiting a winery in a different state, you can send yourself back a few bottles.;

The strictest laws, by far, are found in Utah, Oklahoma, Mississippi, Alabama, Kentucky, and Delaware. Pay particularly close attention to the rules if youre sending wine to those states.;An updated master list of all the state law nuances can be found by searching the alcohol statutes over at The National Conference of State Legislatures website.;

Does Glassware Make A Difference

MD 20/20® Gold Flavored Wine

Dixie cup or fine crystal? Riedel or IKEA? The key to a good wine glass is simple: it must allow you to see, smell, swirl and sip your wine accordingly. This rules out painted and colored glass and typical cocktail glasses. An ideal wine glass is not necessarily expensive, but will have a tulip shape a bowl at the bottom with a narrower opening at the top, allowing a wines aromatics to escape just far enough for your nose to catch. Fine, hand-blown crystal such as Riedel does make a difference when truly analyzing wine, but any appropriately-styled glassware does the job. Some wine glass makers even specialize the shape of the glass to grape variety! Just remember to look for clear, tulip shaped glasses, and youll thoroughly enjoy your wine with every sip.

How To Ship Alcohol Internationally

Importing and exporting alcohol across country borders presents even more challenges. Youll now need to meet state, city, and country laws, as well as be familiar with exporting and importing laws.

Youll need to ensure that the distributor sending the shipment has the correct permits or the US government can seize your shipment. Youll also need to be aware of taxes and duties for international beer, spirit, and wine imports.

We recommend not managing international alcohol shipping yourself instead, work with reliable third-party retailers and compliance companies to ship beer, liquor, and wine orders.

Why This Is Happening Now

While it is true that the consumers residing in the states that do not permit out-of-state retailers to sell to their residents will no longer be able to order any alcohol from an out-of-state retailer, they technically have never been legally able to do so, Koral says.

Many retailers and wine clubs have been shipping wine across state lines for years, a practice that Koral noted has technically always been illegal. Recently increased pressure from state regulators is casting a spotlight on offenders.For instance, for years both FedEx and UPS have held policies stating that they only ship wine from licensed entities. Only in the past year have both have begun putting more effort into enforcing these policies. Now, carriers like FedEx and UPS will refuse to ship the wine, leaving many retailers no way to fulfill interstate orders.

What About Independent Wine Clubs

Wine clubs that are not run by wineries, such as the Wall Street Journal Wine Club, Wine Awesomeness, and International Wine of the Month Club, will be affected differently based on how they operate.

Wine clubs that source juice from producers and then bottle it under their own labels can technically apply for a winery shipping license. Alternatively, wine clubs might partner with local retailers or operate local warehouses to fulfill orders, rather than shipping them across state lines.

While there are legal ways for independent wine clubs to operate, these businesses are far more likely to be affected by stricter shipping regulations.

Wine clubs must understand the requirements which are constantly changing otherwise, they risk acting in non-compliance without even knowing until they are caught, Koral says. Though we cannot condone it, there are always some out there that do understand and are still willing to risk violating laws.

Of the wine clubs that VinePair reached out to, Logan Lee, CEO of Wine Awesomeness, noted that its; members will not be affected, while Wine Access declined to comment.

Changes On The Horizon

As indicated, some states have loosened up their restrictive direct shipping laws with the dawn of the new millennium. Unless direct shipments are prohibited or limited to on-site orders, the wineries usually need a Direct Shippers Permit. They might also need to register at the state, submit reports, or file for in-state tax.;

The catch was to change or, at least, amend the three-tier system which had been in effect since after the Prohibition. This system recognizes three groups in the wine business: wineries , distributors or wholesalers, and retailers. This means a winery sells the label to the wholesaler, who then sells to the retailer, and the retailer was the only one allowed to sell directly to the consumer.;

To continue on a positive note, things are much different now. A lot of states allow direct shipping and sales from the winery to a consumer. As a rule, the wineries and required to obtain proper in-state and/or out-of-state licenses as well as the Direct Shippers Permit. However, the regulations dont stop there.;

Some states, such as Ohio and New Jersey, allow direct shipments to small scale and boutique wineries only. The annual production limit is 250,000 per year for these two states, but it can be much lower than that. For example, Arizona puts a 20,000-gallon limit on the annual winery production.;
