Ohios New Alcohol Delivery Law Comes With Local Detractors
The owner of one Cincinnati business says its a terrible idea.
CINCINNATI – Ohio Gov. Mike DeWine signed a bill into law this week that paves the way for liquor deliveries in the Buckeye state.
Soon Hyde Park Wine and Spirits will be among those businesses able to make those deliveries thanks to House Bill 674, which DeWine signed Wednesday.
The bill can be read in full here. It allows home delivery of alcohol in its original container on all days, including Sundays and holidays. It also removes the 24-hour and 4 a.m. sales provisions.
Hyde Park Wine and Spirits manager Chris Vollrath is against the bill.
I think its a terrible idea myself, Vollrath said. People dont know what they want in general. With liquor, its different than food. People like to shop for their stuff. Its just not a good idea in my opinion.
The bill introduces an F12 license permit for special functions and charitable organizations to have wine and beer at social events.
The Distilled Spirits Council of the United States issued a statement that reads in part:
Governor DeWine has been supportive of multiple consumer convenience measures throughout the pandemic, and this is yet another example of those efforts. Home delivery of distilled spirits is a win for Ohioans and local businesses alike.
Even after the pandemic, Vollrath says hes not interested.

Which States Can I Ship To
Addendum A to the UPS Agreement for Approved Wine Shippers identifies the approved On-Site Purchase States, Winery Direct Shipment States, Retailer Direct Shipment States and Intrastate Retailer States.
The Wine Contract Addendum A is effective as of the “revised” date noted on the Addendum, and applies to all shippers who have entered into a UPS Agreement for Approved Wine Shippers. It is the shipper’s responsibility to ensure that all shipments comply with all applicable laws and regulations in the origin and destination states, and that the consignee is authorized to receive the shipment.

How To Ship Wine: General Overview
First of all, the most important thing to keep in mind is that its illegal for one individual to ship any amount of wine to another person through the mail in the United States, regardless of where you live or whether you try the U.S. Postal Service, UPS, or FedEx.
That doesnt mean you cant send wine to someone but you cant just stuff it in a box and slap a few stamps on it. Unless youre willing to take a big risk and break the law, to ship wine you need to buy it from a company whos certified to deliver it. The good news is, plenty of companies are licensed to ship wine to most states.
Depending on the quantity youre sending and where its going, there could be additional hurdles to overcome. For instance, if you want to send wine to a friend in Oklahoma, youre out of luck: The Sooner State doesnt allow it, and you might be looking at a felony if you get caught trying.
While the law is mostly the same in Delaware, theres one important loophole: If youre a resident of Delaware and youre visiting a winery in a different state, you can send yourself back a few bottles.
The strictest laws, by far, are found in Utah, Oklahoma, Mississippi, Alabama, Kentucky, and Delaware. Pay particularly close attention to the rules if youre sending wine to those states. An updated master list of all the state law nuances can be found by searching the alcohol statutes over at The National Conference of State Legislatures website.
Can Liquor Be Shipped To Montana
Six statesFlorida, Hawaii, Kentucky, Nebraska, New Hampshire and Rhode Islandand the District of Columbia authorize the direct shipment of all spirits as specified. Eight states allow the direct shipment of beer and wine as specified: Delaware, Massachusetts, Montana, North Dakota, Ohio, Oregon, Vermont and Virginia.

How To Ship Wine
Wine shipping is something that many companies desperately want to do. This is especially true for wineries and vineyards who produce large quantities of wine. If you have been trying to figure out how to ship a bottle of wine, or a large quantity of it, then the very first thing that you need to do is to obtain a license to ship it. If you do not have a license, then it is illegal, no matter what state you are in.
After that, you will need to create a special contract with UPS or FedEx. Next, you will have to figure out exactly where you can ship wine. When you know which places you can ship it to, then you can use UPS Freight or FedEx Freight to ship it to its destination.

Is It All Good News
A 2017 New York Times article sent nation-wide ripples across the wine connoisseur community with a conclusion that only 14 states allowed for cross-state wine shipping. However, the legislators have amended some of the regulations by late 2018.
For example, direct shipping has been legal in Oklahoma since October 2018. The carriers and wineries need to follow in-state reporting procedures and pay special taxes. The New York state legislation is unique in that it requires a winerys home state to have similar direct shipping laws as the state of New York itself.

Ohio Attorney General Cries Foul On Winecom And Other Wine Retailers
The state’s attorney general is attempting to use a 21st Amendment power to stop direct deliveries from out-of-state retailers, raising new questions about Ohio’s alcohol shipping laws
Ohio has declared war on several out-of-state wine merchants. Attorney general Dave Yost has filed a request in federal court seeking an injunction against multiple online wine and liquor retailers from other states, alleging that they have been illegally shipping wine directly to Ohio consumers. Under the Buckeye State’s shipping laws, consumers can only order wine from in-state merchants. The sellers named in the injunction include Wine.com, Winc, Pacific Wine & Spirits, Cocktail Courier and Wine Country Gift Baskets, among others. Yost announced last week that he intends to halt the shipments via injunction and the rarely exercised 21st Amendment Enforcement Act.
“We are not aware of any other who has sued using the 21st Amendment Enforcement Act,” David O’Neil, a spokesperson for Yost’s office, told Wine Spectator via email. The act permits state attorneys general to bring a civil action against any person believed to be violating their state’s laws on importing and transporting alcohol.

Wark also points out that Yost has received campaign donations from Ohio alcohol wholesalers, who oppose shipping by out-of-state retailers.
What Are The Different Shipping Methods

Wine Shipping Laws In The United States
Wine shipping laws in the United States differ between states and are controlled by state law. While most alcohol sales are controlled by the three-tier system, nearly all states now permit some form of direct shipping of wine from wineries to consumers. Most states require wineries to pay for a permit in order to ship to consumers in the state, resulting in a winery-dependent slate of states that it may ship to. Direct wine shipments are also typically subject to sales and/or excise taxes. Most states also limit the quantity of wine that may be purchased monthly or annually, usually in terms of the number of nine-liter cases of wine that may be shipped, though most consumers are unaffected by these limits. Shipment of wine to dry areas is illegal.
In the 2005 case Granholm v. Heald, the Supreme Court ruled that states must regulate direct shipment of wines to consumers from in-state and out-of-state wineries in the same way, either allowing or banning both. Since that ruling, more states gradually began to allow direct shipment of wine from wineries to consumers. Some states also allow direct shipment of wine from out-of-state retailers to consumers.
Montana Eyes Legal Direct Shipments Of Wine
House Bill 402has been moving through the Montana Legislature with relatively little opposition, giving us hope that this half-measure direct shipping bill will see the light of day on the floor and pass into law in 2013.
The opposition to the bill has been from the usual suspects: Wholesalers. Their argument in opposition to the bill falls into two general categories:
1. The Current Connoisseurs License which put the onus of complying with regulations and remitting taxes on the consumer is just working great!!
2. Out-of-state wineries should not be allowed to serve Montana residents so easily via direct shipping because, well, just because.
I note that the Montana Direct Shipping bill is a half measure. It is a half measure for the following reasons:
1. It will prohibit Montanans from purchasing wine from out-of-state wine stores2. It will ban the direct shipment of all wines not produced in the United States3. It will ban Montanans from joining wine of the month clubs4. It will ban Montanans from having wine shipped from auction houses.
Still, if passed, LB 402 will be a step in the right direction.

Ohio’s New Alcohol Home Delivery Law Takes Effect: What You Need To Know
COLUMBUS, Ohio Would you like some alcohol delivered to your doorstep? That option is now officially law in Ohio thanks to House Bill 674, which makes alcohol delivery permissible seven days a week including holidays as long as the beverage remains in its original container.
The person receiving the alcohol delivery must be at least 21 years old.
While the new law allows for it, liquor delivery won’t take place until Ohio’s Liquor Control Commission creates processes and rules for sellers.
“They’re going to give us the okay eventually. But that might be some weeks. But we’re speculating. We don’t know. They haven’t given us much guidance yet,” says Jonathan Kerkian, owner of Corkscrew Johnny’s, a liquor agent in Ohio.
The state is inclined to move quickly. Ohio is a “control state,” meanting they’re the wholesaler of liquor across the state. Last year, liquor sales reached a record $1.57 billion, up 19% from 2019. Drizly, an app that facilitates liquor delivery, says Ohio is a trendsetter.
“Control states have a huge revenue stream from the sale of alcohol. And Ohio is one of those states. So it is a leader right now in being the first state that is a control state to authorize the delivery of spirits,” says Jacqueline Flug, Senior VP and General Counsel at Drizly.
What States Do Not Allow Alcohol To Be Shipped
Most states in the US allow alcohol delivery. The states that dont allow delivery at all are Alabama, Mississippi, Utah, and Kentucky, while Rhode Island and Delaware have some restrictions. All other states allow for alcohol delivery but may have some exceptions, rules, or regulations that are specific to that state.
