Yes. No matter what business model you choose, its necessary to register your company and meet the legal requirements for selling alcohol online. Choose a business structure, register for taxes and then apply for licenses and permits.

If youre going to ship wine to another state, you will need a Direct-to-Consumer license. Beware that certain states, such as Utah, Alabama and Delaware, may not receive DTC wine shipments.

What Shipping Carriers Can I Use To Ship Wine

Unfortunately, not every carrier will ship alcohol, and others have a few requirements you must meet.

For example, you cannot ship alcohol via USPS, but you can ship wine, beer, and liquor using UPS and FedEx. Interestingly enough, the reason you cant use USPS to ship alcohol is due to a 1909 law that is still in effect.

In order to ship wine with FedEx or UPS, you must do the following:

  • Register an account.
  • Sign an alcohol transportation contract .
  • Create your shipping label using the carriers electronic shipping solution or an approved third-party platform.
  • Abide by the packaging requirements for wine.
  • Choose the adult signature service option .
  • Affix an alcohol shipping label.
  • You can visit the UPS and FedEx websites to learn more about each carriers shipping requirements.

    Applying For Your Permit

    There are several other important things to know when applying:

    • You will pay sales and excise taxes at the same rate as Texas wineries. There is no personal import tax for consumers.
    • Out-of-state wholesalers or retailers are not allowed to ship wine directly to Texas consumers.
    • The wine must be produced or bottled by the permit holder.
    • The imported wine may not be resold.
    • You do not need TABCâs label approval if youâve met all federal label approval requirements for your brand of wine.

    Classes Of Liquor License

    i. Restaurant license

    This license limits what percentage of a restaurants earnings that can come from alcohol. This goes to say that if you have this license, you are not allowed to sell only alcohol. There is no limit to what type of alcohol you sell though, but you do need to keep the financial limit in mind. This percentage is usually in the region of 40%, so make sure you have that magic number top of mind as you run your business.

    ii. Beer and wine license

    If you dont intend to serve hard liquor, this is the type of license youll need. This license would also limit you to selling only beer and wine.

    iii. Tavern license

    If your business is more of a bar than a restaurant then you will need to obtain a tavern license.

    iv. Commercial hotel license

    The commercial hotel license allows you to sell alcohol for consumption either on the premises or on and off. You will need this type of license to run a hotel.

    Subsidiary on-premises License

    You will need a subsidiary on-premises license when selling liquor for on-premises consumption is a secondary function of your business. Types of businesses that may require this license include:

    • Restaurants
    • Function centres
    • Training institutions.

    Importing Alcoholic Beverages For Resale

    The holder of a Manufacturerâs License or General Distributorâs License who also holds an Importerâs License can purchase beer from the holder of a Nonresident Manufacturerâs License . They can then sell the beer to retailers and distributors in Texas. Beer is defined as a malt beverage containing half of 1% or more alcohol by volume and not more than 4% alcohol by weight.

    The manufacturer of the beer being shipped into this state will need to hold a Nonresident Manufacturer’s License . This license holder may transport beer into Texas by common carrier holding a Carrier’s Permit or in motor vehicles owned or leased by the nonresident manufacturer. This beer may only be shipped and sold to holders of an Importer’s License .

    With some restrictions, the holder of a Wholesaler’s Permit or Winery Permit can purchase wine from the holder of a Nonresident Seller’s Permit outside of Texas. They can then sell the wine to retailers and wholesalers inside Texas.

    A winery outside of Texas or the primary American source of supply will need to hold a Nonresident Seller’s Permit . This permit is required of all entities that export alcoholic beverages containing alcohol in excess of 4% by weight into the state. The nonresident seller must ship their products by a common carrier that holds a Carrier’s Permit and may only sell to the following permit holders in Texas:

    • General Class B Wholesaler

    Can I Sell Alcohol From Food Truck In Texas?
    • Beer/Wine Permit: For the sale and/or consumption of beer and wine only, i.e.: convenience stores, grocery stores, or some restaurants
    • Mixed Beverage Permit: Allows the holder to sell and serve mixed drinks for consumption on the licensed premise, i.e.: bars, hotels, some restaurants, and ice houses that sell liquor only
    • Mixed Beverage Late Hours Permit: For Mixed Beverage Permit holders who sell alcoholic beverages until 2:00 AM
    • Caterer’s Permit: Authorizes the permit holder to sell mixed beverages and/or beer on a temporary basis at a place other than the premise
    • Beverage Cartage Permit: Allows the holder of a mixed beverage permit to transfer alcoholic beverages from the place of purchase to the licensed premise, i.e.: beer delivery companies, liquor delivery companies, or beverage distributors

    How To Start A Wine Business

    There are two approaches to starting a wine business. If you wish to start a wine business where you sell your own wine, you need to have a winery to make your own wine, package it, and sell it from there.

    There is another approach where you dont make your own wine but instead buy huge bulk of wines from different wineries at a wholesale rate and then sell it further to distributors and retailers with a decent profit margin.

    What Time Can You Buy Liquor In Texas Stores

    Texas’s liquor laws are stricter than those for beer.

    Texas liquor stores are closed on Sundays, as well as Thanksgiving, Christmas, and New Year’s Day. If Christmas or New Year’s falls on a Sunday, they have to remain closed on Monday.

However, many breweries, wineries, and even distilleries offer take-home spirits for your parties. If youre into craft brews, this is a great option.

    If youre out of local options, its now legal to buy beer and wine online in Texas! However, mailing restrictions apply, and few places offer in-person pickup.     Bills To Allow Liquor Sales On Sunday Unlikely To Pass

    Two bills House Bill 2232 and Senate Bill 1013 which would have allowed liquor sales on Sunday were left pending in committee. That means they are very unlikely to become law.
