Are There Requirements For Selling Wine Online

TABC Talks: How to legally sell alcohol to go in Texas.

Yes. No matter what business model you choose, its necessary to register your company and meet the legal requirements for selling alcohol online. Choose a business structure, register for taxes and then apply for licenses and permits.

If youre going to ship wine to another state, you will need a Direct-to-Consumer license. Beware that certain states, such as Utah, Alabama and Delaware, may not receive DTC wine shipments.

What Shipping Carriers Can I Use To Ship Wine

Unfortunately, not every carrier will ship alcohol, and others have a few requirements you must meet.

For example, you cannot ship alcohol via USPS, but you can ship wine, beer, and liquor using UPS and FedEx. Interestingly enough, the reason you cant use USPS to ship alcohol is due to a 1909 law that is still in effect.

In order to ship wine with FedEx or UPS, you must do the following:

  • Register an account.
  • Sign an alcohol transportation contract .
  • Create your shipping label using the carriers electronic shipping solution or an approved third-party platform.
  • Abide by the packaging requirements for wine.
  • Choose the adult signature service option .
  • Affix an alcohol shipping label.
  • You can visit the UPS and FedEx websites to learn more about each carriers shipping requirements.

    Applying For Your Permit

The Out-of-State Winery Direct Shipperâs Permit costs $470 and is valid for two years. Visit our New Licenses and Permits page to learn more about applying.

Instructions for reporting and paying excise taxes will be forwarded to you after we issue the permit.

There are several other important things to know when applying:

    • You will pay sales and excise taxes at the same rate as Texas wineries. There is no personal import tax for consumers.
    • Out-of-state wholesalers or retailers are not allowed to ship wine directly to Texas consumers.
    • The wine must be produced or bottled by the permit holder.
    • The imported wine may not be resold.
    • You do not need TABCâs label approval if youâve met all federal label approval requirements for your brand of wine.

    Classes Of Liquor License

    i. Restaurant license

This license limits what percentage of a restaurants earnings that can come from alcohol. This goes to say that if you have this license, you are not allowed to sell only alcohol. There is no limit to what type of alcohol you sell though, but you do need to keep the financial limit in mind. This percentage is usually in the region of 40%, so make sure you have that magic number top of mind as you run your business.

    ii. Beer and wine license

If you dont intend to serve hard liquor, this is the type of license youll need. This license would also limit you to selling only beer and wine.

    iii. Tavern license

If your business is more of a bar than a restaurant then you will need to obtain a tavern license.

    iv. Commercial hotel license

The commercial hotel license allows you to sell alcohol for consumption either on the premises or on and off. You will need this type of license to run a hotel.

    Subsidiary on-premises License

You will need a subsidiary on-premises license when selling liquor for on-premises consumption is a secondary function of your business. Types of businesses that may require this license include:

    • Restaurants
    • Function centres
    • Training institutions.

Restaurant licensees must provide meals or prepared food as the principal activity of their business. The provision of meals must be demonstrated on a daily basis. This means that:

Different Online Wine Selling Business Models

There are several ways that you can start a wine selling business, and whether it will work or not depends solely on who you are and what are your business goals. Still, if we have to offer an alcohol selling business model for the online app and web-based medium, we would suggest two main business models.

    Selling Your Wine Online

Selling Others Wine On Your Platform

Both the business model have their own advantages and challenges, and you need to choose any one of them based on your experience in the wine business and your end goal from this business startup.

Is It Easy To Ship Wine

Alcohol laws vary from state to state. Some states permit wineries to ship directly to consumers, while others prohibit it entirely. Some states fall in the middle, allowing wine to be shipped to customers within the state but forbidding shipments from out-of-state. This means your ability to ship wine will be limited not just by the state your business resides in, but also the states where your customers are located.

The holder of a Manufacturerâs License or General Distributorâs License who also holds an Importerâs License can purchase beer from the holder of a Nonresident Manufacturerâs License . They can then sell the beer to retailers and distributors in Texas. Beer is defined as a malt beverage containing half of 1% or more alcohol by volume and not more than 4% alcohol by weight.

The manufacturer of the beer being shipped into this state will need to hold a Nonresident Manufacturer’s License . This license holder may transport beer into Texas by common carrier holding a Carrier’s Permit or in motor vehicles owned or leased by the nonresident manufacturer. This beer may only be shipped and sold to holders of an Importer’s License .

With some restrictions, the holder of a Wholesaler’s Permit or Winery Permit can purchase wine from the holder of a Nonresident Seller’s Permit outside of Texas. They can then sell the wine to retailers and wholesalers inside Texas.

A winery outside of Texas or the primary American source of supply will need to hold a Nonresident Seller’s Permit . This permit is required of all entities that export alcoholic beverages containing alcohol in excess of 4% by weight into the state. The nonresident seller must ship their products by a common carrier that holds a Carrier’s Permit and may only sell to the following permit holders in Texas:

How To Start A Wine Business

There are two approaches to starting a wine business. If you wish to start a wine business where you sell your own wine, you need to have a winery to make your own wine, package it, and sell it from there.

There is another approach where you dont make your own wine but instead buy huge bulk of wines from different wineries at a wholesale rate and then sell it further to distributors and retailers with a decent profit margin.

The process of starting both kinds of wine businesses is explained in detail in the blog above.

What Time Can You Buy Liquor In Texas Stores

Texas’s liquor laws are stricter than those for beer.

Texas liquor stores are closed on Sundays, as well as Thanksgiving, Christmas, and New Year’s Day. If Christmas or New Year’s falls on a Sunday, they have to remain closed on Monday.

Every other day, Texas liquor stores, sometimes called “package” stores, operate from 10am to 9pm.

What Other Locations Can You Buy Beer/wine/liquor

Of course, you can buy beer, wine, and liquor at any liquor store in Texas. Multiple other retailers sell at least some kind of alcohol. The type thats hardest to get a hold of is straight liquor. Essentially, you cant find whiskey, vodka, or any other kind of liquor at any place other than a liquor store.

However, many other places sell beer and wine. You can buy beer and wine at many Texas grocery stores, including H-E-B, the classic Texas grocery store. While the laws still apply, you dont have to go to a liquor store to find the beer and wine you need!

Alcohol in the grocery store is especially lovely if you need alcohol on a Sunday. Even though the liquor stores are closed, you can still find something to drink as long as its the afternoon. Convenience stores and gas stations also have a selection of beers. It is usually pretty limited, however.

Another place to find beer, wine, and liquor is at your local brewery or winery. Of course, you can go and drink some cocktails or beer while youre visiting. However, many breweries, wineries, and even distilleries offer take-home spirits for your parties. If youre into craft brews, this is a great option.

If youre out of local options, its now legal to buy beer and wine online in Texas! However, mailing restrictions apply, and few places offer in-person pickup. The same selling and open hours laws apply as well. While its an improvement, the online liquor business will probably see some growth soon.

Why Have There Been Limits On Sunday Alcohol Sales In Texas

According to a 2016 Ken Herman column in the American-Statesman, “From 1961 through 1985, the Texas Blue Law banned the sale of an odd collection of 42 items on both days of the weekend. It forced many stores to close on Sundays and others to rope off sections with stuff they couldn’t sell. The 1985 Legislature killed the Blue Law, save for the portion covering package liquor stores and auto dealers, effectively keeping them closed on Sundays.”

Why 2022 Is The Perfect Year To Launch A Wine Business

We all knew that soon every business would be selling its products and services online. Some adopted this trend early, while some tend to catch up after their sales started to drop. 2021 was a disastrous year in terms of health and economic factors. Weve seen the loss of countless lives as well as money, but theres always a silver lining to every gray cloud.

A quick adaptation of digitization in businesses has been the silver lining of 2022. Businesses have understood the importance of being present for their customers at the touch of a button. Several stores and small businesses were late to upgrade and have now closed for good.

If you own one of the lucky alcohol wineries or stores that are still alive or are yet to start your business journey, make sure digitization is the first thing on your mind. Although the year may seem very gloomy even to try, it is still the perfect year if you plan to launch an on-demand wine delivery business.

An alcohol delivery service app does a lot more than just being a new channel of sales for alcohol drinks. It enables wine merchants to collect information about wine consumers that can be used to categorize their customers into small groups. Then these merchants can create hyper-targeted marketing strategies, offer customized deals, and give them a personalized experience via the liquor delivery app.

So, as I said earlier, make sure that digitization is the prime objective on your mind when you launch your wine business this year.

    Examples Of Wine Ecommerce Websites

TABC Talks: How to legally deliver alcohol to consumers in Texas

When it comes to ecommerce, your homepage is your digital welcome mat. And for higher-end merchandise like wine, first impressions are especially important.

Because the culture and tradition of wine drinking has a unique influence on the decisions of wine buyers. And wine drinkers have particular expectations about the merchants with whom they shop.

The first time a shopper visits your website, they dont necessarily have to be blown away .

But they shouldnt be completely unimpressed, either. And they absolutely cannot be disappointed or irritated by an unaesthetic design or non-user-friendly navigation.

Your wine ecommerce website should tell the story of your brand and invite customers to become part of your community.

The design of your site should demonstrate your commitment to providing an exceptional shopping experience for every shopper from wine novices to wine connoisseurs to non-wine drinkers shopping for a gift.

There should be no barriers between the customer and what theyre looking for.

For a little inspiration, here are three wine ecommerce websites built with the customer experience in mind.

Why It Matters That Amazon Is Selling Wine In Texas

Texas has long been one of the most complicated states for wineries and producers to do business in. It is riddled with dry counties and home to complicated sales legislation.

As Amazon is close to celebrating its full first-year of Whole Foods ownership, the Seattle chain has made some clever inroads to the wine sales market in several major Texas cities. As of June, the chain rolled out one-day wine delivery in Dallas, Fort Worth, Austin, Houston and San Antonio. One- and two-hour delivery windows are available as well.

    Going Through the Right Channels

Unlike some other alcohol-delivery services, the forward-thinking chain has always checked all its boxes. Amazon stopped selling wine online via its own site, which never had much traction, from the moment it acquired Whole Foods. Trade analysts and consumers alike expected some fancy footwork from the chain and it has performed as expected.

A number of permits were requested from the Austin-based Texas Alcoholic Beverage Commission, so drinks ordered could be stored and shipped from a number of local warehouses. Drivers are trained to check customer identification upon delivery to prevent minors purchasing alcoholic beverages.

Bills To Allow Liquor Sales On Sunday Unlikely To Pass

Two bills House Bill 2232 and Senate Bill 1013 which would have allowed liquor sales on Sunday were left pending in committee. That means they are very unlikely to become law.

The Boot the Ban lobbying effort to get lawmakers to repeal the Sunday ban on alcohol sales targeted the May 22 NASCAR race in Austin and sponsored the No. 26 car, but their efforts appear to have failed.
