In a statement, the Distilled Spirits Council of the United States praised the move as a convenience for consumers and a safe alternative way for adults to purchase and enjoy their favorite spirits at home during the pandemic. Mississippi is one of 17 states that tightly control the sale of liquor, and one of 10 that sell spirits to all private package stores. Seven directly own all the liquor stores in their states.

Mississippis warehouse and distribution, run by the Alcoholic Beverage Control division of the Department of Revenue, has for years struggled to keep up with demand and new products and its warehouse is too small and antiquated. Lawmakers have been reluctant to sink money into upgrades of the warehouse and system.

Measures to allow Mississippi grocery stores to sell wine or to allow mail-order wine deliveries to Mississippi homes have for years generated debate in the Legislature, but gained no traction this year.

How is wine defined?3-1-2 Wine means any alcoholic beverage containing not more than 24 percent alcohol by volume made from fruits, berries, or grapes either by natural fermentation or by natural fermentation with brandy added. The term includes, but is not limited to, all sparkling wines, champagnes, combinations of such beverages, vermouths, special natural wines, rectified wines, and like products. Going Back To The 21st Amendment

The majority of the US liquor laws that include shipping regulations came after the 21st amendment effectively ended the Prohibition. That said, specific shipping requirements and permits were, and still are, up to state governments.

Bear in mind, these laws had been in effect long before UPS, FedEx, and other carriers. To make things more complicated, some states require a winery or retailer to be physically present in the state to be eligible for direct shipping. As for the most restrictive states, Mississippi, Kentucky, and Utah top the list.

However, the laws dont only apply to wine businesses, but they also effectively make individuals subject to penalties. For example, it would be illegal to send a bottle of wine to your friend in New York if you live in Montana. To avoid penalties such as these, some carriers have introduced rules of their own.

You would need special agreements if you were to ship via UPS and FedEx. On the other hand, the United States Postal Service refuses alcohol shipments altogether. But is there a silver lining?

There isnt a universal answer to this question, as it depends on the laws and regulations in each state, city, and county that both the seller and buyer are located in.

Mississippi is one of the states where it is completely ILLEGAL to get wine shipped in to you. In Mississippi, in-state wineries cannot ship directly to a consumer so there are no discriminatory practices. The Court further ruled that the states have the ultimate authority to regulate wine and alcohol as they see fit.

Changes On The Horizon

As indicated, some states have loosened up their restrictive direct shipping laws with the dawn of the new millennium. Unless direct shipments are prohibited or limited to on-site orders, the wineries usually need a Direct Shippers Permit. They might also need to register at the state, submit reports, or file for in-state tax.

The catch was to change or, at least, amend the three-tier system which had been in effect since after the Prohibition. This system recognizes three groups in the wine business: wineries , distributors or wholesalers, and retailers. This means a winery sells the label to the wholesaler, who then sells to the retailer, and the retailer was the only one allowed to sell directly to the consumer.

To continue on a positive note, things are much different now. A lot of states allow direct shipping and sales from the winery to a consumer. As a rule, the wineries and required to obtain proper in-state and/or out-of-state licenses as well as the Direct Shippers Permit. However, the regulations dont stop there.

Starting this summer, Mississippi will allow home delivery of liquor, beer, wine or light spirits from local package stores or retailers.

Republican Gov. Tate Reeves signed House Bill 1135 on Wednesday, and it will become law July 1.

Buyers will have to prove they are at least 21, delivery people will have to be at least that old and deliveries cannot be made to any person who appears intoxicated. Deliveries also cannot be made to dry counties or cities.

How To Pack Liquids For Shipping

Alcoholic beverages often come in glass bottles which are significantly more delicate than their plastic counterparts. For this reason, you need to be especially careful when you are shipping glass wine bottles, beer bottles, or liquor bottles, or shipping liquids in other delicate containers.

To safely ship alcoholic beverages, you should use strong cardboard boxes that have trays inside of them that provide sections for each bottle.

This will keep the bottles separate and prevent them from smashing into one another. You can also wrap the bottles in bubble wrap for additional safety. You may want to do this if you are shipping very expensive wine.

After that, you can put packing peanuts into the box and then close the top of the box and tape it shut. Then carefully stack the boxes into the truck.
