Can I Bring My Own Food Or Beverages

In compliance with FDA regulation and our GL policy, we do not allow outside food, beverages, or containers of any kind on-premise. This policy includes cake, coffee , sealed plastic water bottles, personal water bottles , thermoses, tumblers, juice, milk, snack foods, coolers, etc. However, we designed our food menu to pair beautifully with our wines. Ask any server for their recommendation.

Regardless of preference, allergy, or dietary restrictions, guests cannot bring any outside food, beverage, or container onto the winery property.

Will Digital Retailers Be Affected

Retailers like Wine.com and national retail chains like Total Wine & More are not typically affected by DTC shipping restrictions because they have considerable resources. Total Wine & More, for instance, has brick-and-mortar stores across the U.S., all of which have in-state sales licenses with which they can ship wine orders. Online retailers without physical locations may have the ability to be present in states that do not allow DTC retailer shipping to get around these barriers, through local warehouses or retail partners.

We are licensed and pay sales and excise taxes in the states where we need to, Rich Bergsund, CEO of Wine.com, says. This includes operating our own local warehouses which carry retail licenses just like a store in states where that is necessary. Bergsund stresses that these changes will not effect Wine.com consumers.

Unfortunately, smaller, specialty retailers typically cannot afford to operate local warehouses to get wines across state lines.

Other wine sales sites, like Vivinos Marketplace, merely act as an intermediary between consumers and local retailers, so consumers shouldnt have an issue using these types of sites. However, wine lovers should pay attention to the retailers to which they are directed even if a wine shop in New Jersey is just a few miles away, a Manhattan-dweller is not explicitly allowed to purchase wine and ship it into New York.

Indiana Loosens Restrictions On Wine Shipping

Anaba Wines Team

FORT WAYNE, Ind. Indiana has the strictest alcohol restrictions in the country, but a new law is loosening up some of the rules. After the bill to remove the ban on Sunday sales died in the statehouse, it seemed like itd be another uneventful year for alcohol-related legislation. However, thanks to Senate Bill 113, consumers can now get wine shipped to their home without having to visit the winery first.

to read the full bill.

Local wineries like Country Heritage and Two EEs said it gives Indiana a chance to be more competitive in a growing industry.

It does open up a whole new world, Country Heritage Winery owner Jeremy Lutter said.

I think its just going to bring us up to par with a lot of the other people were trying to catch up with- other states.

Lutter said the old law could be a hassle at times.

People that had even been here before in the past, if theyre interested in us shipping, theyd have to come up and revisit to sign this piece of paper, Lutter said.

The old law required consumers to visit a winery first and sign paperwork. That way, the winery could confirm the buyer is at least 21 years old. Consumers arent totally off the hook, though. The new law still requires you to provide a copy of a government-issued ID. Exactly how consumers will send that proof of identity and age is yet to be determined. Since the law doesnt take effect until July, lawmakers and the Alcohol and Tobacco Commission are still working out some details.

How To Ship Wine: General Overview

First of all, the most important thing to keep in mind is that its illegal for one individual to ship any amount of wine to another person through the mail in the United States, regardless of where you live or whether you try the U.S. Postal Service, UPS, or FedEx.

That doesnt mean you cant send wine to someone but you cant just stuff it in a box and slap a few stamps on it. Unless youre willing to take a big risk and break the law, to ship wine you need to buy it from a company whos certified to deliver it. The good news is, plenty of companies are licensed to ship wine to most states.

Depending on the quantity youre sending and where its going, there could be additional hurdles to overcome. For instance, if you want to send wine to a friend in Oklahoma, youre out of luck: The Sooner State doesnt allow it, and you might be looking at a felony if you get caught trying.

While the law is mostly the same in Delaware, theres one important loophole: If youre a resident of Delaware and youre visiting a winery in a different state, you can send yourself back a few bottles.

The strictest laws, by far, are found in Utah, Oklahoma, Mississippi, Alabama, Kentucky, and Delaware. Pay particularly close attention to the rules if youre sending wine to those states. An updated master list of all the state law nuances can be found by searching the alcohol statutes over at The National Conference of State Legislatures website.

Why Must I Select A State Before Shopping

We ship from multiple warehouses due to state laws, so PRICES AND SELECTION MAY VARY depending on which state you ship to PLEASE start shopping on Wine.com by first using the state drop-down menu to select the state where you want your items delivered. Once you choose your desired delivery state, our site will adjust the selection we offer to ensure you are only shown items that we can legally ship to that state. CHANGING STATES FROM YOUR CART MAY CHANGE YOUR ORDER! To avoid this unfortunate experience, it is best practice to empty your cart and select your state before you shop!

Will Estate Wine Clubs Go Out Of Business

Probably not. Because laws make it much easier for wineries to obtain DTC shipping licenses, consumers in most states shouldnt have issues with participating in winery-run wine clubs or purchasing wine to be shipped directly from a winery, both online and in person.

However, wineries typically have to apply and pay for licenses in each state to which they would like to ship, so Koral cautions that not all wineries may want to go through the effort of getting licensed in all 42 DTC states.

Why Interstate Wine Shipping Is So Complicated

Direct-to-Consumer alcohol shipping is governed by individual state regulations, and any person or business looking to legally ship wine needs a DTC license. For most alcohol retailers, the license is covered by their off-premise wine sales licenses. A California retailer, for example, can generally legally ship wine to residents of California.

If an out-of-state entity wants to obtain a license to legally ship wine to another state, however, it must apply for a separate, specific DTC license.

According to Alex Koral, industry relations advisor for ShipCompliant, a company that works with wineries to facilitate compliance, there are currently 42 states that offer out-of-state entities licenses to ship DTC in their states. Residents of Utah, Oklahoma, Delaware, Alabama, Mississippi, and Kentucky may not receive any DTC wine shipments, for the most part in Utah, non-compliance is actually a felony.

What About Independent Wine Clubs

Wine clubs that are not run by wineries, such as the Wall Street Journal Wine Club, Wine Awesomeness, and International Wine of the Month Club, will be affected differently based on how they operate.

Wine clubs that source juice from producers and then bottle it under their own labels can technically apply for a winery shipping license. Alternatively, wine clubs might partner with local retailers or operate local warehouses to fulfill orders, rather than shipping them across state lines.

While there are legal ways for independent wine clubs to operate, these businesses are far more likely to be affected by stricter shipping regulations.

Wine clubs must understand the requirements which are constantly changing otherwise, they risk acting in non-compliance without even knowing until they are caught, Koral says. Though we cannot condone it, there are always some out there that do understand and are still willing to risk violating laws.

Of the wine clubs that VinePair reached out to, Logan Lee, CEO of Wine Awesomeness, noted that its members will not be affected, while Wine Access declined to comment.

New York Has Additional Regulations

New York regulations prohibit wine and food from being shipped in the same package. Gifts and Baskets ordered that include both food and wine will be sent in two separate packages. Your gift message will be included in both packages and your Order Confirmation will show two order numbers that will also be given to separate tracking numbers once they are shipped.

Packaging For Wine Freight Shipping And Beer Freight Shipping

The first thing to note about shipping beer, wine, and liquor needs extra attention paid to its packaging. A lot of these products are bottled in glass, and glass breaks easily, even if youre careful. Package any bottles you are sending in as much bubble wrap as possible to avoid this. Put the wrapped bottled in boxes, and stuff the boxes with newspaper or packing peanuts to fill up the space and create more of a buffer. This way, even if things do get jostled during the shipping process, they wont shatter.

Why You Can’t Ship Your Favorite Wine Across State Lines: Tom Wark on Arcane Alcohol Regulations

You’ve fallen in love with a Bordeaux produced at a small French vineyard, and you can’t imagine life without this fruity concoction. Unluckily for you, however, “once you’re changing countries, gets exponentially more difficult,” says Weinberg. First, Weinberg advises, you will have to “make sure the product can be legally shipped into the destination without a permit.” You can check this guide to see your state’s individual regulations. If you don’t, your “product could be seized, quarantined, or destroyed,” warns Weinberg. And no one wants that, do they? Shipping out of the U.S. into another country will require you to brush up on state and federal export rules and the import rules of whichever country you’re sending it to . Good luck. Once again, it’s probably best to go through a retailer or distributor.

Weinberg also recommends that you confirm with the retailer or distributor if any taxes or duties need to be paid on the product you intend to ship. If so, they should be able to advise you on how to pay them, and how much they will cost you. Lastly, “purchase from a reputable dealer who knows the ins and outs of laws, and ideally has experience shipping to your destination of choice,” Weinberg advises.

In short, as much as you might like to personally pick up, wrap and send a bottle of booze as a gift, this is one task better left to professionals.

How To Ship Alcohol Internationally

Importing and exporting alcohol across country borders presents even more challenges. Youll now need to meet state, city, and country laws, as well as be familiar with exporting and importing laws.

Youll need to ensure that the distributor sending the shipment has the correct permits or the US government can seize your shipment. Youll also need to be aware of taxes and duties for international beer, spirit, and wine imports.

We recommend not managing international alcohol shipping yourself instead, work with reliable third-party retailers and compliance companies to ship beer, liquor, and wine orders.

While it is true that the consumers residing in the states that do not permit out-of-state retailers to sell to their residents will no longer be able to order any alcohol from an out-of-state retailer, they technically have never been legally able to do so, Koral says.

Many retailers and wine clubs have been shipping wine across state lines for years, a practice that Koral noted has technically always been illegal. Recently increased pressure from state regulators is casting a spotlight on offenders. For instance, for years both FedEx and UPS have held policies stating that they only ship wine from licensed entities. Only in the past year have both have begun putting more effort into enforcing these policies. Now, carriers like FedEx and UPS will refuse to ship the wine, leaving many retailers no way to fulfill interstate orders.
