How To Pack Liquids For Shipping

Alcoholic beverages often come in glass bottles which are significantly more delicate than their plastic counterparts. For this reason, you need to be especially careful when you are shipping glass wine bottles, beer bottles, or liquor bottles, or shipping liquids in other delicate containers.

To safely ship alcoholic beverages, you should use strong cardboard boxes that have trays inside of them that provide sections for each bottle.

This will keep the bottles separate and prevent them from smashing into one another. You can also wrap the bottles in bubble wrap for additional safety. You may want to do this if you are shipping very expensive wine.

After that, you can put packing peanuts into the box and then close the top of the box and tape it shut. Then carefully stack the boxes into the truck.

When Reviewing This Information Keep The Following In Mind:

  • The rules weve compiled here only reflect regulations that a state would impose on a wine supplier located in a different state, looking to enter a new market. They do not include rules on setting up a production plant, or for federal or home-state compliance.
  • This is not a definitive or complete guide. It should be used only as a starting place, to help lead you in the right direction as you expand your distribution. Do not take this as the final word on any regulatory issue.
  • When you actually approach selling in a new state, be sure to consult with someone who can properly interpret how the rules apply to your individual circumstances: your compliance team, your legal counsel or even another winery located in that state.

And dont forget that Sovos ShipCompliant offers several tools to help you in this process, with a cloud-based, easy-to-use platform for your licensing, product registration, product management and state filing needs. What this image doesnt show you is that there are several states with additional rules and fees, making it hard for small wineries to deliver their wines to you. Lets look at some of the details on the archaic laws of wine shipping:

  • If you live in Alabama you have to get special prior written approval from the Alcohol Beverage Control Board and prepay for deliveries.
  • If you live in Utah youre a criminal if you bring more than 2 bottles of wine home from your travels.
  • If you live in Arizona or New Mexico you can only receive 2 cases of wine annually thats only one bottle every two weeks!
  • If you live in Colorado, Idaho, Louisiana, Montana, Nevada, South Carolina, Texas, Virginia, West Virginia and Wyoming, wineries must buy a yearly permit just to ship to you.
  • If you live in New Jersey large wineries cant ship you wine. No
  • If you live in California, Oregon, Washington, Alaska or Maryland you can pretty much get whatever you want, as long as they can get it to you.

Since you wont be crossing state lines, youll only need to meet the alcohol shipping requirements of the state youre located in. However, you will need to be familiar with the local city laws for the different towns and municipalities in your state. Luckily, alcohol distributors should already be familiar with their local laws regarding alcohol production, distribution, and sales.

Consumers can also use one of the many alcohol e-commerce and delivery app companies such as Drizly or WineDirect to order alcohol directly to their home or to send beer, wine, or spirits to a friend.

Montana Eyes Legal Direct Shipments Of Wine

House Bill 402has been moving through the Montana Legislature with relatively little opposition, giving us hope that this half-measure direct shipping bill will see the light of day on the floor and pass into law in 2013.

The opposition to the bill has been from the usual suspects: Wholesalers. Their argument in opposition to the bill falls into two general categories:

1. The Current Connoisseurs License which put the onus of complying with regulations and remitting taxes on the consumer is just working great!!

2. Out-of-state wineries should not be allowed to serve Montana residents so easily via direct shipping because, well, just because.

I note that the Montana Direct Shipping bill is a half measure. It is a half measure for the following reasons:

1. It will prohibit Montanans from purchasing wine from out-of-state wine stores2. It will ban the direct shipment of all wines not produced in the United States3. It will ban Montanans from joining wine of the month clubs4. It will ban Montanans from having wine shipped from auction houses.

Still, if passed, LB 402 will be a step in the right direction.

Wine Shipping Laws In The United States

Wine shipping laws in the United States differ between states and are controlled by state law. While most alcohol sales are controlled by the three-tier system, nearly all states now permit some form of direct shipping of wine from wineries to consumers. Most states require wineries to pay for a permit in order to ship to consumers in the state, resulting in a winery-dependent slate of states that it may ship to. Direct wine shipments are also typically subject to sales and/or excise taxes. Most states also limit the quantity of wine that may be purchased monthly or annually, usually in terms of the number of nine-liter cases of wine that may be shipped, though most consumers are unaffected by these limits. Shipment of wine to dry areas is illegal.

In the 2005 case Granholm v. Heald, the Supreme Court ruled that states must regulate direct shipment of wines to consumers from in-state and out-of-state wineries in the same way, either allowing or banning both. Since that ruling, more states gradually began to allow direct shipment of wine from wineries to consumers. Some states also allow direct shipment of wine from out-of-state retailers to consumers.

Internet Sales & Residential Shipping

Without exception, five types of Arizona liquor licenses are permitted to take orders via Internet and ship liquor to a private residence or non-liquor licensed business in Arizona. Of these five types, annual production determines this privilege. The five license types are:

  • Out-of-state Farm Winery that produces less than 20,000 gallons of wine annually
  • Out-of-state Craft Distiller that produces less than 20,000 gallons of spirits annually
  • In-state Craft Distiller that produces less than 20,000 gallons of spirits annually.
  • Direct Shipment that sells and ships no more than the allowable number of nine-liter cases of wine that is produced by the licensee.
  • Wine and distilled spirits are the two types of spiritous liquor that may be shipped into or within Arizona via Internet order. If you are shipping/receiving spiritous liquor from a business other than one of the five licenses listed above, it is unlawful.

An in-state or out-of-state farm winery that produces less than 20,000 gallons of product per calendar year may take orders from Arizona residents in person, by internet, by telephone, mail or catalog for personal consumption, not for resale.
