How is wine defined?3-1-2 Wine means any alcoholic beverage containing not more than 24 percent alcohol by volume made from fruits, berries, or grapes either by natural fermentation or by natural fermentation with brandy added. The term includes, but is not limited to, all sparkling wines, champagnes, combinations of such beverages, vermouths, special natural wines, rectified wines, and like products. The term does not include cooking wine mixed with salt or other ingredients so as to render it unfit for human consumption as a beverage. How To Pack Liquids For Shipping

Alcoholic beverages often come in glass bottles which are significantly more delicate than their plastic counterparts. For this reason, you need to be especially careful when you are shipping glass wine bottles, beer bottles, or liquor bottles, or shipping liquids in other delicate containers.

To safely ship alcoholic beverages, you should use strong cardboard boxes that have trays inside of them that provide sections for each bottle.

This will keep the bottles separate and prevent them from smashing into one another. You can also wrap the bottles in bubble wrap for additional safety. You may want to do this if you are shipping very expensive wine.

After that, you can put packing peanuts into the box and then close the top of the box and tape it shut. Then carefully stack the boxes into the truck.

House Bill 402has been moving through the Montana Legislature with relatively little opposition, giving us hope that this half-measure direct shipping bill will see the light of day on the floor and pass into law in 2013.

The opposition to the bill has been from the usual suspects: Wholesalers. Their argument in opposition to the bill falls into two general categories:

1. The Current Connoisseurs License which put the onus of complying with regulations and remitting taxes on the consumer is just working great!!

2. Out-of-state wineries should not be allowed to serve Montana residents so easily via direct shipping because, well, just because.

I note that the Montana Direct Shipping bill is a half measure. It is a half measure for the following reasons:

1. It will prohibit Montanans from purchasing wine from out-of-state wine stores2. It will ban the direct shipment of all wines not produced in the United States3. It will ban Montanans from joining wine of the month clubs4. It will ban Montanans from having wine shipped from auction houses.

Still, if passed, LB 402 will be a step in the right direction.

Wine shipping laws in the United States differ between states and are controlled by state law. While most alcohol sales are controlled by the three-tier system, nearly all states now permit some form of direct shipping of wine from wineries to consumers. Most states require wineries to pay for a permit in order to ship to consumers in the state, resulting in a winery-dependent slate of states that it may ship to. Direct wine shipments are also typically subject to sales and/or excise taxes. Most states also limit the quantity of wine that may be purchased monthly or annually, usually in terms of the number of nine-liter cases of wine that may be shipped, though most consumers are unaffected by these limits. Shipment of wine to dry areas is illegal.

In the 2005 case Granholm v.
