Why You Can’t Ship Your Favorite Wine Across State Lines: Tom Wark on Arcane Alcohol Regulations

There are many cost calculators out there for your specific case so the costs won’t be covered in this resource. And of course, your provincial liquor board will be calculating all this for you, so you can see what it costs at the time of their assessment. Here is a screenshot taken from the LCBO web site showing the calculations they use:

Is Bringing Alcohol From Quebec To Ontario Illegal

A: Yes. The Government of Ontario amended Regulation 718 under the Liquor Licence Act. Individuals are now permitted to bring any quantity of beverage alcohol into Ontario on their person from other Canadian provinces or territories, as long as it is for personal consumption and not for re-sale or commercial use.

New York Has Additional Regulations

New York regulations prohibit wine and food from being shipped in the same package. Gifts and Baskets ordered that include both food and wine will be sent in two separate packages. Your gift message will be included in both packages and your Order Confirmation will show two order numbers that will also be given to separate tracking numbers once they are shipped.

If A Shipment Cannot Be Delivered

A re-route charge of $14 + tax may be applicable if a secondary address re-route is required after order has shipped.

If you are not home to receive your package on the first delivery attempt, the driver will leave a door knocker indicating the location you can pick it up at. If it is not picked up after 5 days, it is returned to the winery. A second freight charge will apply to packages that need to be re-delivered.

Here’s How To Import It

Many Canadians living in California, France, Germany, or other wine-rich areas of the world build lovely wine collections. When the time comes to move back to Canada, their wine collection is part of their household and naturally, it should come too. Easy, right? Unfortunately, not. Here are some key things you need to understand:

  • Each province is responsible for its alcohol laws and alcohol import processes. All provinces tightly control the importation, distribution, and retailing of wine, beer, and hard liquors – even imports from other provinces! Obviously this is for public health concerns, but it is even more important to their revenues…tax revenues. There is so much tax revenue generated from wine, beer, cider, and hard liquor sales every year that each province relies heavily on it to meet their budgetary needs.
  • BC and Ontario produce lots of their own wine. So the governments of these provinces are even more sensitive to imports from other provinces and countries than the non-wine producing Canadian provinces. Wine production is big business, employs a lot of people, and generates tons of tourism revenue. Tourism generates more tax revenue for all levels of government from this side of the industry, too. Except of course in 2020 and 2021 when revenues from Tourism in BC plummeted to a tiny fraction of their norms.
  • The federal government in Canada brings in substantial duties and taxes from alcohol importation and sales, too. Billions of dollars every year.

Can You Ship Alcohol

Lets get the most obvious question out of the way: as a consumer, are you able to ship alcohol to yourself? Unfortunately not. Shipping alcohol is illegal for consumers unless for some reason they have the proper permits and licensing that allow them to distribute alcohol. But why? These federal regulations were put in place after the 21st amendment was finalized when the US decided that people were allowed to drink again, but with some state-by-state guidance. One of the requirements for shipping alcohol would be that for consumers, it was a no go.

Now, licensed sellers of alcohol are a different story, whether that be a vineyard or a tequila start-up. Licensed sellers and retailers of alcohol will prioritize having the proper permits to ship alcohol, whether that be nationally or globally, so that they dont have to deal with too many road bumps along the way. They must be aware of state laws and local regulations on shipping alcohol and keep up with other state requirements for delivery. So unless youre a licensed seller of spirits, youre unlikely to be able to ship someone your favorite cocktail fixings or bottle of red anytime soon.

How To Package Spirits For Shipping

Same with beer and wine, the packaging requirements for spirits will depend mostly on the way the liquor is being stored. Liquor is an especially unique liquid to ship, as the slightest interference within the transit could compromise the curated taste or worse, waste the product all together. While the glass bottles used for storing liquor are much thicker than wine or beer bottles, theyre still subject to breakage without proper preparation. Some of the general rules for shipping spirits include:

  • Prevent Glass from Touching Glass: The easiest way liquor bottles are able to shatter during the delivery is against one another. Choosing to package bottles with cardboard dividers and proper padding to eliminate shuffling is a must when shipping liquor bottles. Boxes going on top of boxes are inevitable during shipping, so make sure to shrink wrap pallets to prevent boxes from shifting.
  • Consider Insurance: Liquor is priced at a much higher value than beer or wine, so making sure your shipment is insured is crucial for guaranteeing youre prepared for any issues that come up down the line. Its always better to be safe than sorry, especially when sending spirits.

Can I Ship Wine

If youre a wine retailer, youve certainly thought about how to send your wine to different places. In many cases, you will be able to send your wine across the world quite easily. But, the key is knowing all the restrictions and regulations so you understand how to navigate them. Here are a few things to know:

  • Since all countries have different rules about shipping wine, its helpful to brush up on the wine export and import rules of the areas you ship to most frequently.
  • In the US, you cant mail wine as a gift through the post office – you have to use commercial carriers like UPS or FedEx.
  • Youll need to make sure your carrier is fully aware that your shipment contains wine
  • Youll need to fill out paperwork like customs declarations, whether you intend the wine as a gift or as a commercial consignment.
  • Check whether there are any additional taxes or duties that youll need to pay on the wine shipment – and if the answer is yes, find out how much itll cost and how you can make the payment.

How To Pack Wine Bottles For Shipping With A Courier

Shipping wine with a courier may seem a little tricky. However, proper wine packaging when sending a few bottles among other belongings in an ordinary package assures a safe delivery and is neither impossible nor uncommon.

  • Wrap the bottles individually with bubble wrap to protect your bottles during transit. You can also place each wine bottle in a leak-proof plastic bag to protect your package in case of spillage.
  • Put the wine bottles into a carton box. Fill any empty space left with cushioning material.
  • Close and seal the shipping box. Attach the label if needed. You can also add a sign Fragile or Handle with care on the top of your wine packaging.

Ron Kubek already has a celebratory bottle picked out for the day he finds out he can sell his wine anywhere in the country.

Hell open a sparkling wine the Blanc de Noirs from his Elysia Vineyard in British Columbias Okanagan Valley. Its one of his more popular bottles Lightning Rock, the winery he owns, is doubling its production of the wine after selling out of it in July.

Thats the one that we would like Canadians across the country to be able to use when they celebrate the end of the COVID or when they celebrate New Years, he said. We want them to be able to enjoy our sparkling.

Kubeks going to have to hold off on popping that cork for a while. In fact, at this point he says, its easier to ship that bottle of bubbly to London, England, than it is to send it to London, Ont.

Thats because, right now, there are only four provinces in the country that will allow Kubek to ship his bottles directly to consumers across provincial borders. Ontario and Quebec, two of the biggest markets in the country, are not among them.

But that could change if Kubeks MP in the Okanagan has his way potentially making brewers, winery owners and distillers from coast to coast a lot happier.

In December, Conservative MP Dan Albas, who represents the Central Okanagan-Similkameen-Nicola riding in B.C., tabled a bill hes dubbed the Buy, Sip and Ship bill, more formally known as Bill C-260.

What Is The Legal Drinking Age In Canada

Just as there is a different set of rules regarding alcohol in each of the 10 provinces and three territories, so it goes for how old one has to be to legally consume alcohol in Canada.

Depending on the province, the age is either 18 or 19 years old. Unlike the United States which outlawed the purchase of alcoholic beverages by anyone under 21 with the National Minimum Drinking Age Act of 1984 Canada does not have a federally-mandated age in which a person can legally buy alcohol.

The following provinces allow 18 year olds to drink:

    • Alberta
    • Saskatchewan
    • Yukon Territory

In order to protect against underage drinking, the provinces instruct places selling alcohol to ask anyone who appears to be 25 years old or younger to provide identification upon purchase.

How Is Alcohol Sold In Canada

Again, the word complex comes to mind. Theres no simple answer to describe the way in which a customer can legally purchase alcohol without going province by province, since each one has set its own rules. Almost uniformly, Canadian businesses who wish to sell alcohol are required to buy it through the government agency in their province or territory, at the prices set by the government. Also there is not really a wholesale market for independent stores or bars to benefit from. Whether a business buys 1 bottle of wine or 100, the cost is the same per unit in Canadian provinces with no discount for buying in volume.

Lastly, the government prices the alcohol in such a way as to make it prohibitively expensive for a person to overconsume. An example of this:

    • In September 2019, a case of Budweiser which is brewed by LaBatt Breweries in Canada for the Canadian market and therefore not considered an import costs $42.99 in Canadian dollars at Liquor Mart in Manitoba, compared to less than $20 at a Wal-Mart in America. Even with the Sept. 25 exchange rate of 1.33 Canadian dollars for every 1 American dollar factored in, the Budweiser costs $12 American dollars more for the same product.

Because alcohol sells for more across the board in Canada, it stands to reason a supplier would be able to sell its product for more money to the various provincial organizations.

Saskatchewan: Hotels, government-owned stores and private contractors can all sell liquor in this province.

Dont Be Afraid To Ask Your Carrier

    Irish Coffee Glasses

Heres the bottom line: if you dont know something, just ask your carrier! UPS and FedEx have a lot of guidelines for you to follow in order to ship alcohol. However, both UPS and FedEx employ lots of customer service representatives ready to help you out at a moments noticeand that help goes a long way. Just remember to stay away from USPS on this oneat least until the laws change.
