Why Does My Receipt List Different Discounts Than What I Saw In My Shopping Cart

How To Mail Alcohol Out
When you cross state lines, the shipment of alcohol becomes more difficult. That its because you now must meet the requirements and regulations in both the state youre shipping from and the state youre shipping to.
There is a loophole that helps consumers ship beer, liquor, and wine to other states if that other state permits the shipment of alcohol to consumers. Is It Legal To Mail Alcohol
There isnt a universal answer to this question, as it depends on the laws and regulations in each state, city, and county that both the seller and buyer are located in.
Why is that? When Prohibition ended with the 21st Amendment, it gave states the power to regulate and set their own laws on the sale of alcoholic beverages in their states.
There are some universal rules for shipping alcohol that include:
- Alerting the carrier that a shipment contains alcohol
- Paying a special alcohol package fee
- An adult that is 21 or older must sign for the package
Ag Nessel Files Suit Against Out
Michigan Attorney General Dana Nessel has filed lawsuits against two out-of-state wineries and one wine retailer for allegedly shipping wine into Michigan illegally.
The lawsuits, filed Wednesday in the U.S. District Court for the Western District of Michigan, allege New York City wine retailer Taste Wine LLC, Castello di Amorosa of Californias Napa Valley, and Grants Pass, Ore-based Schmidt Family Vineyards LLC violated the 21st Amendment Enforcement Act. The federal law allows states to enforce their liquor laws in federal courts.
In all three cases, the wine merchants were allegedly caught shipping wine into Michigan without the necessary licensing. The AGs Office also claims that the state issued the companies cease and desist letters, but all three allegedly continued shipments into Michigan despite the initial warnings.
Out-of-state wine shipments have been a contentious legal issue in Michigan for more than 15 years, dating back to a 2005 U.S. Supreme Court ruling that deemed it unconstitutional to bar out-of-state wineries from shipping into Michigan and New York while allowing the same privileges for in-state wineries.
More recently, in May 2020, a three-judge panel of the Sixth Circuit U.S. Court of Appeals ruled that Michigan laws that excluded out-of-state retailers from shipping into the state were constitutional. The U.S. Supreme Court upheld the decision earlier this year.
Nessels office could not immediately be reached for comment.

Nearly 160000 Bottles Of Wine Illegally Shipped Into Michigan A Steep Decline After Ag Crackdown

More than a third of alcohol shipped into Michigan during the first quarter of 2020 was shipped illegally. This might not seem like an obvious cause for celebration but the Michigan Beer and Wine Wholesalers Association is raising a glass as the industry corks the flow of illegal alcohol into the state.
The association found a 78% drop from 2019s illegal alcohol shipping numbers after compiling data from carrier reports from the Michigan Liquor Control Commission and excise tax data from the state of Michigan.
Association president Spencer Nevins gives credit to Attorney General Dana Nessel for her increased enforcement of illegal alcohol shipments. The prosecution of out-of-state retailers caught shipping wine illegally into Michigan has resulted in tens of thousands of dollars. Nessel and the MLCC have sent a clear message, Nevins said.
Every bottle of alcohol illegally shipped into our state hurts small, independent retailers that are proud to call Michigan home, pay taxes and give back to their communities, Nevins said.
State law prohibits out-of-state retailers to ship wine into Michigan. Wineries must be licensed by the Michigan Liquor Control Commission before they can legally ship wine directly to Michigan customers.

If no one is available at your home address to receive your shipments, please ship your order to your office or another location where someone will be present. If, after three delivery attempts, your wine is returned to us, you can request that your order be shipped to a different address. Additional shipping fees will be charged to your credit card.

What If I’m Not Home When My Shipping Order Arrives
Upon delivery, our delivery partners will ask to see the receivers ID to ensure they are 21 or older. The receiver will also be required to sign for the order. If you are unable to be home, we will make two additional attempts to deliver your order, and then it will be held at the shippers distribution center.

Both states prohibit direct to consumer shipments. In Utah violations are a felony.
Delaware
Direct shipments via common carrier are prohibited. Under Federal Law passed in 2002, Delaware residents visiting on-site at a winery may have wine shipped back to Delaware for their own personal use.
Arkansas
Off-site direct-to-consumer sales are prohibited, however, Act 483 of 2013 allows wineries holding a Wine Shipping Permit to ship up to 1 case of wine in any calendar quarter to an Arkansas consumer who purchased the wine on the premises of the winery. Arkansas consumers must participate in an on-site sale in order for wine to be shipped directly to them.
Rhode Island
The direct shipment of off-site sales are prohibited. Effective July 13, 2001, Rhode Island changed from a state requiring consumer permits for direct shipment to a limited shipping state whereby Rhode Island residents must participate in an on-site sale in order for wine to be directly shipped to them. The law permits out-of-state wineries to ship wine orders that are personally placed by the purchaser at the manufacturers premises, for shipment to an address in Rhode Island, for non-business purposes.
Michigan is suing three wineries, including one in the Napa Valley, plus a wine retailer alleging they shipped wine into Michigan without obtaining the proper licenses.

Us Supreme Court Backs Off Shipping Case
In a perplexing but also predictable decision, the US Supreme Court declined Monday to hear a wine-shipping case from Michigan that now throws into question again whether or not states can discriminate against out-of-state retail stores.
The Court’s decision not to hear the case of Lebamoff v. Whitmer is a big setback for enophiles who like hard-to-get wines, and undermines a 2019 Supreme Court decision that appeared to eliminate such uneven laws.

“This is a terrible decision for retail stores,” beverage alcohol attorney Sean O’Leary told Wine-Searcher. “The only ones that can afford to operate in multiple markets are Total Wine and Whole Foods. They’re just handing the market over to them. Also, now you have people stuck at home by Covid-19. They want to buy wine and they can’t buy wine. The states could be collecting taxes on it. There are a lot of losers. The only winners are the big chains.”
The immediate result is that people in can order wine online from retail stores in their own state, but not from out-of-state.
It’s not impossible that other states might look at the Supreme Court’s disinterest in the Michigan law and impose their own restrictions on retail wine orders from out-of-state. Big wine distributors are powerful players in state legislatures and they spend plenty of political donation money to protect their monopolies.

There is a term in journalism called burying the lede. It refers to when a reporter leads off a story or writes a story in which the main point is non-existent or buried deep in the story. The Michigan Beer and Wine Wholesalers provided a classic example with their recent announcement concerning illegal wine shipments into the state.
A recent story run by a few Michigan TV stations reported the claim by the Michigan Beer and Wine Wholesalers Association that 185,408 bottles of wine were illegally shipped into the state of Michigan in the last quarter of 2018. In the story, the wholesalers bemoan the fact that these wine shipments not only took tax revenue away from the state but also deprived Michigan wine retailers of sales.
But nowhere in the story or claims by the wholesalers was there any investigation as to why Michiganders felt the need to go out of state to buy their wine, nor how the supposed lost tax revenue could be obtained. Thats the story.
Put another way, its the Michigan wine wholesalers who are falling down on the job. Moreover, if the wine isnt available in the state, its not a lost sale for the local retailer. They didnt have the wine to sell in the first place.
Suit was filed immediately after the 2017 law was passed. Last year, a federal judged ruled, again, that it was unconstitutional. It cost the state hundreds of thousands of dollars to defend that law in court.
