In April, 2020, Kentucky passed HB 415, which established new rules permitting the direct-to-consumer shipping of alcoholic beverages. Early on December 14, 2020, the Kentucky legislatures joint committee on Licensing, Occupations, and Administration Regulations voted to approve new regulations enforcing HB 415 making those laws effective and finally allowing DtC shipping to begin in the state.

The approval of these regulations allows the Kentucky Alcoholic Beverage Control to issue approved licenses to applicants for the new License to Direct Ship to Consumers. Once an applicant receives their approved license and completes any other required registration with the states Department of Revenue, they may begin selling and shipping alcoholic beverages directly to Kentucky residents.

Notably, Kentuckys bill will allow all alcoholic beverages to be shipped to the states residents. However, only parties that hold a production license issued by their home state will be eligible for a License to Direct Ship to Consumers, meaning retailers are not permitted to ship DtC into Kentucky.

This new set of laws replaces previous statutes for DtC shipping to Kentucky, which for various reasons proved ineffective. The laws under HB 415 closely resemble other states DtC shipping laws and it is expected that the state will soon prove to be a valued new destination for DtC shippers.

Can You Ship Wine To Kentucky

Wineries are allowed to ship wine to Kentucky under certain conditions.

Until July 2020, alcohol was not allowed to be shipped directly to customers in Kentucky. This one was one of only 5 states that had this particular legislation.

This wine shipping law was overturned, however, and a new bill was passed allowing the shipping. Wineries outside of Kentucky are now allowed to ship wines directly to customers, with a 9 liter limit per customer, per year.

This was a significant law to be overturned, as it allowed customers outside of Kentucky the ability to join monthly wine clubs of Kentucky wineries, and they would be able to have those wines delivered to their homes.

Kentuckys Unconstitutional Alcohol Shipping Law Debuts

If there is a community of people who desperately need access to wine, beer and spirit shipments from out-of-state its the poor, deprived residents of the state of Kentucky. Consider this, in the past 36 months, the state of Kentucky has approved 45,877 wine, beer and spirit products for sale in the state. Meanwhile, in that same period, the Federal Government has approved over HALF A MILLION products for sale in the U.S. Yes, thats less than 9% of the alcohol products available to Kentuckians.

This pitiful access to products in the state is the primary reason why Kentuckians have good reason to celebrate the beginning of alcohol shipments into the state this week in the wake of HB 415 having passed earlier this year that allowed shipments from out-of-state producers.

But wait, heres more.

Consider this, while Kentuckians kneel at the alter of the crappy selection of alcohol products sold by the states wholesalers and while they start to look to the promise of shipments from out-of-state wineries, distillers and brewers, they still will lack access to more than half of those 500,000 products approved by the Feds over the past three years. This is due to the fact that Kentucky bars shipment of alcohol by out-of-state retailers and it is this group and only this group that sell imported wine.

Kentucky State Senate Passes Wine Shipping Bill

LOUISVILLE, KY – Kentucky wine lovers, get excited. A bill that would let you ship wine directly to your door has passed the state senate.

Kentucky is only one of five states that doesnt currently allow wine shipping.

But a bill has passed the state Senate that could change that.

Senate Bill 99 would allow for each person to receive up to 24 cases of wine from a seller annually.

The founder of a new wine club said that shes excited all of her Kentucky members could start receiving shipments.

Anything that makes it easier for folks across the country to travel without having to go anywhere and experience new things, whether its the bourbon from Kentucky or the wine from California or Italy, is an incredible opportunity, Sarah Pompei of The Authentic Irpinia Wine Club said.

The bill was amended to make sure people and vineyards wouldn’t be able to bypass paying taxes by shipping wine.

The bill passed the Senate 29-5 and will now go to the House.

New Kentucky Law Allows Alcohol To Be Shipped

LOUISVILLE, Ky. — A new Kentucky law allows alcohol to be shipped to people.

Rep. Adam Erlanger recently placed the first online order.

The new law also lets Kentucky-based distilleries, wineries and breweries to ship products to other states that have the same law.

Before the new law, limited shipping was available but required someone to be there in-person. Now, that isn’t needed.

An ID is required at sale and delivery.

And the state’s wet/dry laws still prevents the sale of alcohol in “dry” communities.

Now, here is some local Kentucky wine industry scoop: Kentuckys wine industry made a comeback in 1976 when a new state law allowed local farms to grow wine grapes once again. Consequently, many vineyards and wineries began to open, and by 1982, the Kentucky Vineyard Society was revived. Notably, the state established a program that encourages viticulture initiatives by funding half of the startup costs associated with opening a new vineyard. The wine industry has continued to grow, with grape acreage quadrupling from 1998 to 2002.

Currently, Kentucky has 583 acres of grapevines, maintained by over 113 grape producers. Typically, the state produces around two million gallons of wine each year. The majority of the states fifty-five licensed wineries produce wines from European, French-American hybrids, and American varietals. Vidal Blanc is the most prevalent, closely followed by Cabernet Sauvignon and Chambourcin. Most of Kentuckys wineries are located in the central and northern regions of the state and are encompassed by the Ohio River Valley AVA, a region including areas of Indiana, Kentucky, Ohio, and West Virginia. This particular AVA is the largest viticultural area in the country, covering an impressive 16,640,000 acres, though it is important to note that only a small percentage of this land is used for grape production.

What Are The Rules For Shipping Into Kentucky

Like all states that permit DtC shipping of alcohol, Kentucky imposes many rules on shippers. These include:

  • DtC shippers must first receive a License to Direct Ship from the Kentucky ABC. This license costs $100, and must be renewed annually.
  • The application for this license requires the applicant to provide proof that they have registered with the Kentucky Secretary of State as a business operating in the state.
  • The application also requires the applicant to provide copies of their deed or lease for the licensed premises that they will ship from.
  • Once DtC shippers have received their License to Direct Ship, they must also register with the Kentucky Department of Revenue to collect and remit the states sales and alcohol taxes.
  • DtC shippers must register their brand/labels with the Kentucky ABC prior to shipping them into the state.
  • DtC shippers are permitted to ship only brands of beverage alcohol that they own or have an exclusive license to use alcoholic beverages shipped must be produced by the licensed shipper, or produced or bottled for them exclusively by other manufacturers.
  • DtC shippers should take good faith efforts to verify they are not making a sale to anyone under 21, including ensuring that their carriers check the recipients ID at the time of delivery.
  • A single DtC licensee is limited to shipping:
  • No more than 10 gallons of spirits per month per individual
  • No more than 10 cases of wine per month per individual
  • The states 6% sales tax

    Kentucky Finally Opens For Dtc Alcohol Shipments But With A Catch

    Update March 15, 2021: Kentucky HB 415 was signed into law on March 12, 2021. See below for details.

    Update March 5, 2021: Kentucky may soon allow holders of a direct shipper license to use third parties to fulfill shipments. The Bluegrass State authorized direct-to-consumer shipments of beer, wine, and spirits last year, but not the use of fulfillment houses. This oversight has an enormous impact on wineries lacking widespread national distribution, as they typically use licensed fulfillment houses to reach customers in other states.

    House Bill 415 allows direct shipper licensees to use a third-party fulfillment house that holds a storage license or transporters license . A third party may operate from the premises of the direct-shipper licensee or from another business location.

    The direct shipper licensee not the fulfillment house will be liable for any violations of KRS 242.250, 242.260, 242.270, or 244.080 by the third party.

    The measure was introduced February 9, 2021, and is already on its way to Governor Andy Beshears desk. It will take effect upon its passage and approval by the Governor or upon its otherwise becoming a law. The governor has 10 days to act on a bill after its received.
