What About Independent Wine Clubs

Wine clubs that are not run by wineries, such as the Wall Street Journal Wine Club, Wine Awesomeness, and International Wine of the Month Club, will be affected differently based on how they operate.

Wine clubs that source juice from producers and then bottle it under their own labels can technically apply for a winery shipping license. Alternatively, wine clubs might partner with local retailers or operate local warehouses to fulfill orders, rather than shipping them across state lines.

While there are legal ways for independent wine clubs to operate, these businesses are far more likely to be affected by stricter shipping regulations.

Wine clubs must understand the requirements which are constantly changing otherwise, they risk acting in non-compliance without even knowing until they are caught, Koral says. Though we cannot condone it, there are always some out there that do understand and are still willing to risk violating laws.

New Yorkers Will Find It Harder To Buy Out

The days when people living in Albany or Buffalo, Rochester or Binghamton could order wine or other alcohol from a retail store anywhere in the United States and have it shipped to their door appear to be over.

It’s illegal in New York . And even though customers have been doing it for years, it’s probably always been illegal,;New York Times drinks writer;Eric Asimov reported.

This does not, however, apply to shipments directly from wineries or other alcohol manufacturers. Those sales have been legal in New York and elsewhere since 2005 and continue to be.

The change involving retail outlets has been coming in the past year or so, ever since major shipping companies like United Parcel Service and Federal Express began feeling pressure to adhere to the law. They’ve told retailers they will only ship wine, beer or spirits to one of the 14 states that explicitly permit such sales.

New York is not one of those states. A bill that would have relaxed New York’s prohibition on out-of-state retail alcohol sales failed to make it out of committee last year, but could be reintroduced in 2018, the New York Times reported.

At the same time, Amazon.com is;ending its specialty online wine market, Amazon Wine, as of Dec. 31. It will continue to offer wine through some of its other services, like Amazon Fresh, and Prime Now.

“The decision made it a two-way street,” Crowley said.

In the wake of my post Wednesday, “Texas Wine Shipping Prohibition Is Morally Indefensible ,” I wanted to follow up with some tips on how to ship wine legally to Texas.

Although it hasn’t been updated for more than two years, the Texas Alcoholic Beverage Commission does have an informative page on wine shipping within and from outside our state.

Shipping from an out-of-state retailer is prohibited in Texas, but individuals may ship wine to Texas as long as the shipments are “non-commercial transactions.”

According to the TABC site, “If you are an individual interested in shipping wine to a friend or family member in Texas as a gift, you may do so, as long as you use a TABC-licensed common carrier.”

Beverage Alcohol Retailers Look To Clear Legal Hurdles To Ship Wines To Out

Despite an online shopping spike during the Covid-19 pandemic and the historic 2005 High Court ruling outlawing discrimination against out-of-state businesses, retailers still face major wine shipping roadblocks. But retailers are not backing down. A recent U. S. Supreme Courts decision not to hear a lawsuit challenging a Michigan law preventing out-of-state retailers from shipping wine to state consumers is the tip of a legal iceberg drifting into hot judicial water. The law, allowing only in-state retailers to ship wines to Michigan consumers, was being challenged as discriminatory.;We are not surprised by the result, says Robert Epstein, an attorney for the plaintiffs. We filed a petition cert to get on the Supreme Courts radar screen. Since there are eight other pending cases, theyre waiting for more to percolate up.

Similar legal challenges are pending at the federal level in California, Illinois, Indiana, Kentucky, New Jersey, North Carolina, and Rhode Island. Epstein, who is also involved in the cases in these other states, anticipates decisions coming next in Missouri, Illinois, and Indiana. We will be going back to the Supreme Court sometime in the near future, Epstein says.

For a golden moment, motivated wine lovers could rely on high-speed internet as a sort of national wine shop. A consumer in Little Rock, Ark., for example, unable to find particular bottles locally, could order them from a shop in New York. It required only a willingness to pay shipping costs.

Those days are no more. In the last year or so, carriers like United Parcel Service and FedEx have told retailers that they will no longer accept out-of-state shipments of alcoholic beverages unless they are bound for one of 14 states that explicitly permit such interstate commerce.

New York is not one of those 14 states, as The New York Timess wine panel learned to its chagrin in the last year.

All of the bottles we sample at our wine tastings are purchased retail. When Bernard Kirsch, our tasting coordinator, could not find the wines he wanted in New York, he ordered from elsewhere, doing regular business with retailers in California and New Jersey, among other places. I, too, like many wine lovers, occasionally bought wine from out-of-state shops for my personal consumption. But that has ended.

Strictly speaking, it was probably never entirely legal in New York or in many other states to have wine shipped in from out-of-state retailers. Yet, these laws requiring a license for interstate wine shipments seemed vague and were rarely enforced.

Thats one of the happy miracles of the age, said Jamie Wolff, an owner of Chambers Street Wines in New York.
