Shipping Wine To Pa

Don't Miss

S For Packing Your Wine

Pennsylvania Court Says Special Wine, Liquor Orders Can Be Sent Directly To Retailers

Now that you know everything you should about navigating regulations around shipping wine and what you need to think about, heres a step-by-step guide to packing your wine when youre ready to start shipping:

  • Wrap the bottles of wine individually using bubble wrap, cartons, tissue, or any other protective material that will help the bottle withstand any shocks while in transit.
  • Put the bottles into a smaller carton or box, separating them using cardboard dividers or any other cushioning materials – dont forget to fill up any empty spaces to limit movement!
  • Seal the smaller box and carefully place it into a larger box. Fill up any spaces in between the boxes with available cushioning materials – after making sure that the boxes are properly secured, seal the whole thing off with tape.
  • Attach polystyrene sheets to the outside of the bigger cardboard box to act as a shock absorber and further protect the wine bottles in transit.
  • Put this package into a third sturdy box and fill up any empty spaces – cover the top with more polystyrene before taping the lid shut with a generous amount of sealant.
  • Properly label your package with fragile or handle with care signs on the top and sides of the carton.

How Much Will Wines Cost

Pricing for wines at the private wine shops will be variable. It will be up to the individual stores how to price their wines, but it will take a brilliant wine buyer to keep prices down and quality high.

Having private wine shops is a remarkable thing, but the law does not fully privatize wine sales. The PLCB will control both the availability and wholesale price of the wine. The shops will have an inflated wholesale price, as well: The PLCB will tack on 10% to the wholesale cost, plus the 18% emergency tax will also be incorporated into the wholesale cost. Plus, private wine shops can only sell 4 bottles of wine at a time.

Bottomline for the Consumer: The private wine shops will not offer good pricing on popular wines. Due to unnaturally high wholesale costs, those wines will cost more than in surrounding states. It is also very likely that prices will be lower in the PLCB Wine & Spirits stores.

Duty rates will be charged on your wine shipment. These are usually based on the alcohol content of each bottle, not the value of the wine itself. Generally, when you ship wine, you can expect to be charged $1-$2/liter of wine. The rates are higher for spirits like vodka and cognac. You can always find any additional information you may need to help you figure out exactly what taxes youll need to pay, depending on the destination country.

Importing and exporting alcohol across country borders presents even more challenges. Youll now need to meet state, city, and country laws, as well as be familiar with exporting and importing laws.

Youll need to ensure that the distributor sending the shipment has the correct permits or the US government can seize your shipment. Youll also need to be aware of taxes and duties for international beer, spirit, and wine imports.

We recommend not managing international alcohol shipping yourself instead, work with reliable third-party retailers and compliance companies to ship beer, liquor, and wine orders.

Direct Shipping To Pa

Wineries can now ship directly to consumers, up to 36 cases annually. The law does not allow retail wine stores to ship to PA, only wineries. This law puts PA law into line with the standards of wine shipping throughout the US, which has enormous benefits for the wine trade.

For a winery to ship to a customer in PA, they will have to obtain a direct wine shipper license from the Pennsylvania Liquor Control Board , which will cost $25o per year. There will be two taxes on the wines. First is a gallonage tax of $2.50 per gallon, adding $0.43 per bottle to the price. Sales tax for PA will also have to be collected. In Philly, that tax is currently 10%.

The 18% Johnstown Flood tax will not be levied for direct shipments of wine.

Bottomline for the Consumer: Now we can have wine shipped to us, just like everyone else in America.

There Are A Few Zip Code Restrictions

Local laws prevent us from shipping to certain zip codes that are considered “dry zip codes” in Alaska, Florida, Idaho and New Hampshire. We do ship to most of the zip codes in these states, but our system will tell you if the zip code you enter is one that is excluded by law at the time the order is placed, after the shipping address and zip code is entered.

How To Get A Liquor License

For the first time since prohibition, new liquor licenses will be available annually. These licenses are not actually new, but ones that were revoked or mothballed for various violations. There are hundreds of these licenses, and the PLCB will hold an annual auction to sell 50 of these licenses in every county.

There are currently 625 such licenses available, with an additional 200 estimated to be available in FY 20162017. The minimum bid is set at $25,000 the Senate Appropriations Committee estimates that the average selling price will be $75,000.

The effect of these annual auctions will likely be a devaluation of the current high cost of liquor licenses, somewhere between 10 and 25%. If you have a liquor license you want to sell, I suggest doing so before the auctions were implemented in 2017.

Breweries & Brew Pubs

Winc * New Wine Subscription!! #WincWine

Several paragraphs in the law are beneficial to the beer trade. The brewpub license has been extended. It now allows for serving PA wine and PA distilled spirits for on-site consumption.

The law also creates the PA Malt and Brewed Beverages Industry Promotion Board, which will oversee 1 Million dollars in annual grants. This is welcome new funds aimed at promoting local brewing. It will not take long before PR firms jump on this upcoming new revenue stream.

For breweries, there is also a tax credit for capital expenditures, up to $200k annually. The combination of tax credit and the grant is a smart combination that will help build our vibrant brewing culture.

There is one potential negative in the bill, as it allows beer wholesalers to have up to 5 locations:

Nevertheless, there are provisions in this Bill that significantly benefit beer wholesalers and have a drastic effect on franchise laws in the Commonwealth of Pennsylvania that could lead to the ultimate demise of many small breweries.

For more details, attorney Ted Zeller has written a brief on the subject.

Bottomline for the Consumer: Our local beer culture is going to get a shot in the arm. Expect our local beer heroes to take it up a notch.

How To Ship Alcohol To Another State

When your booze crosses state borders, “you need to consider the laws for both the shipping state and the receiving state,” says Weinberg. So, for example, if you’d like to send a bottle of wine from a visit along Pennsylvania’s wine trail to a relative in Mississippi, don’t waste your time or your money. While it’s perfectly legal to mail wine from this northern state, it’s also perfectly illegal to receive wine shipments in Mississippi.

In other words, Mississippi is not a reciprocal state, a state in which you can receive alcohol shipments from other states or countries, explains Lekkala. You can read more about reciprocal states and other out-of-state shipment rules here.

Of course, there’s an easy way around these convoluted laws, too. Mostthough not allalcohol that can be purchased in one state can be found somewhere in another, so if you’re dying to ship your brother a new brew, hit the web first to see if you can find a retailer in his state that carries the beverage, recommends Lekkala. It will be much easier to provide a credit card number over the phone than try to send that brew between states. “Even state-controlled stores realize they’re losing business to other states and improving the range of inventories they’re carrying,” Lekkala says.

Wine Manufacturers In New York State

New York State wineries may ship up to 36 cases of wine per year directly to a New York resident for personal use. The winery must require the purchaser to provide proof they are 21 or over, and that the wine is for personal use and not for resale.

Shipping containers used to deliver wine must be conspicuously labeled with the following:

“Contains Wine

For Personal Use and Not For Resale

Signature of Person Age 21 or Older Required for Delivery

Delivery to an Intoxicated Person is Forbidden by Law”

New York State wineries must require the common carrier delivering the wine to verify the identity and age of the recipient by means of photographic identification, obtain the signature of the recipient on an “acknowledgement of receipt” form provided by the Authority and refuse delivery to recipients who refuse to present proof of age.

New York State wineries must maintain records of all direct wine shipments and produce them at the request of the Liquor Authority or the NYS Department of Taxation and Finance.
