The Alabama Legislature on Thursday gave its final approval to legislation that would allow wineries anywhere in the country to ship limited quantities of wine directly to Alabama consumers. The bill, HB437, will become law if signed by Gov. Kay Ivey.

This follows a bill, SB126, passed earlier by the Legislature and signed into law by the governor that will allow ABC Board-licensed businesses in the state to deliver wine, beer and spirits to customers homes.

In addition, numerous other bills were introduced in this session of the Legislature and are in various stages of the legislative process with their fates undetermined. This session, the ABC Board has tracked 39 bills dealing with alcoholic beverages or affecting some aspect of our regulatory functions. We have not experienced as high a volume of bills in my 10-year tenure as administrator of the ABC Board.

With such a barrage of bills, both passed and pending, its easy to be confused, especially by various versions of legislation dealing with seemingly related topics.

Let me try to clarify things a bit regarding the two bills that have perhaps generated the most confusion home delivery of beer, wine and spirits and direct shipment of wine .

While these bills might sound similar, they are vastly different.

While the measure allows the delivery of beer, wine and spirits, it sets limits on the amounts that can be sold to a customer in any one day.

Addendum A to the UPS Agreement for Approved Wine Shippers identifies the approved On-Site Purchase States, Winery Direct Shipment States, Retailer Direct Shipment States and Intrastate Retailer States.

The Wine Contract Addendum A is effective as of the “revised” date noted on the Addendum, and applies to all shippers who have entered into a UPS Agreement for Approved Wine Shippers. It is the shipper’s responsibility to ensure that all shipments comply with all applicable laws and regulations in the origin and destination states, and that the consignee is authorized to receive the shipment.

  • If you live in Colorado, Idaho, Louisiana, Montana, Nevada, South Carolina, Texas, Virginia, West Virginia and Wyoming, wineries must buy a yearly permit just to ship to you.
  • If you live in New Jersey large wineries cant ship you wine. No
  • If you live in California, Oregon, Washington, Alaska or Maryland you can pretty much get whatever you want, as long as they can get it to you.

Alabamas New Dtc Application Process Is A Doozy And The Dust Hasnt Yet Settled

Last May, Alabama passed a law authorizing wineries to ship wine directly to consumers in the state starting August 1, 2021. This is an exciting development for wine enthusiasts in Alabama and wineries nationwide. Its also a major change that entails developing a new application process in a short period of time. Currently, its a work in progress.

The Alabama Alcoholic Beverage Control Board published a Direct Shipment/Wine Fulfillment Checklist and Pre-Application on August 1, 2021, the day direct-to-consumer shipments into Alabama officially began. In early September, it updated the checklist and pre-application form. A third version of the pre-application may be released by mid-October, after the ABC finalizes its regulations.

Many wineries are eager to register and start exploring the Alabama market. However, most are waiting to see exactly whats required of them before beginning the application process. There are a couple of key differences between the first and second iterations of the pre-application/checklist more could emerge if there’s a third.

The pre-application and checklist released August 1 included a lot of the usual requirements and a few unusual ones. The usual suspects include:

New York Has Additional Regulations

New York regulations prohibit wine and food from being shipped in the same package. Gifts and Baskets ordered that include both food and wine will be sent in two separate packages. In a momentous shift, SB126 allows ABC Board-licensed businesses in the state to deliver wine, beer and spirits to customers homes. The law allows licensees to use either their employees or third-party contractors to deliver alcohol to customers. There are limits to the amount of alcohol that can be sold per customer in any one day. For canned or bottled beer, the maximum is 120 12-ounce containers. For draft beer, the maximum is 288 ounces. For wine and spirits, its 9,000 milliliters or about 12 750-milliliter bottles.

Businesses with on-premises retail liquor licenses, such as restaurants, cannot exceed 375 milliliters of alcoholic beverages per customer, and the delivery must also be accompanied by a meal.

Delivery employees are subject to criminal background checks and must be trained and certified through the licensees pre-approved training program to help with identifying underage or intoxicated individuals and fake or altered IDs. Drivers must ensure payment has been processed before removing the alcohol from the premises. To confirm customers are age 21 or older, they are required to provide a signature and government-issued ID that drivers then verify using ID scanning software. If the recipient cannot prove his or her age, fails to provide a signature, or appears intoxicated, the delivery person must return the alcoholic beverage delivery to the retailer.

Starting Aug 1 2021 Wineries Can Ship Wine Directly To Alabama Homes Fulfillment Center License Created

Beginning Aug. 1, wineries can ship limited quantities of wine to Alabama homes, under Act No. 2021-419.

On May 13, 2021, the governor signed the new law, which has an effective date of Aug. 1.

The worked-out legislation by Rep. Terri Collins, R-Decatur, along with Sens. J.T. Jabo Waggoner, R-Vestavia Hills, and Sen. Bobby Singleton, D-Greensboro, cleared both chambers of the Alabama Legislature the last week of April.

Only wineries, not retailers, will be able to ship wine to homes, under the legislation the Senate passed April 29, Collins said. The House concurred in the changes later that day.

enacted earlier in the session would allow home delivery of sealed beer, wine and liquor by delivery services, breweries and distilleries, off-premise alcohol licensees and those with on-premise restaurant retail liquor licenses . The alcohol delivery legislation is effective Oct. 1.

The application fee will be $200 with a $150 annual renewal fee for the direct wine shipper license. An annual $500 fee for the fulfillment center license, plus $100 for each premise from which shipments are made.

Besides the shipping provisions, the law sets conditions for franchise agreements between suppliers and wine wholesale distributors.

Singleton and Collins presented companion bills in the 2020 and 2019 sessions that also would have allowed wine to be shipped directly to consumers.
