    For retailers and non-retailers alike, making sense of shipping regulations when it comes to shipping alcohol in the United States can be challenging. Each state not only creates its own regulations regarding alcohol shipments, but individual counties within that state may also have fashioned their own rules. So, the question of the day is: can you ship wine to California?

    The short answer is, yes, you can. Individuals or retailers with the proper licensing can ship alcohol to California, or from California to different states. Where you live, where and who you are sending to, and how much wine you want to ship are all questions that should be asked before you take your package to the nearest post office.

    Can I ship wine to California? Individuals without the proper licenses are not allowed to send alcohol. USPS prohibits the shipping of alcohol by individuals. People who want to ship wine through FedEx or UPS can do so, but have to have the right license and sign an agreement with their chosen shipping carrier. This typically means you must be a commercial entity. At the other end of the shipment, an adult over the age of 21 must sign for the package to obtain it legally.

    The New Law For Direct Shipping Of Wine Into Massachusetts

    Law Offices of John P Connell, P.C.: In January 2015, Massachusetts will become the most recent State to allow direct shipment of wines to consumers with the recent passage of the 2015 Massachusetts Budget. Section 61B of the 2015 Budget includes the new direct shipping provision which will be codified in Massachusetts General Laws, Chapter 138, § 19F. The new law will state that a new Direct Shippers Permit may be issued to wineries by the Massachusetts Alcoholic Beverages Control Commission where the winery holds a federal basic permit as well as a license in the commonwealth or any other state to manufacture and export wine and is in the business of manufacturing, bottling or rectifying wine. The language of the new law requiring a winery be licensed to manufacture wine in the Commonwealth of Massachusetts or any other state, however, will exclude wineries from outside of the United States from acquiring the new Direct Shippers License.

    The initial licensing fee will be $300.00 to be submitted with the ABCC application with a $150.00 annual renewal fee

    The winery using a common carrier must obtain the signature from someone of legal drinking age who receives the shipment

    The wineries must report shipments it makes into Massachusetts each year to the ABCC and it must pay corresponding excises taxes on such shipments

    Deliveries into Massachusetts are limited to 12 cases per year for each customer

    Retailers, on the other hand, have a much steeper hill to climb. Three additional states California, New Mexico, and Idaho allow retailers to ship on a reciprocal agreement, meaning that if another state allows this states retailers to ship DTC, they will do the same.     Massachusetts has become the 40th state to legalize winery direct-to-consumer shipping. On July 11, Gov. Deval Patrick signed the 2015 state budget, which includes language legalizing direct shipping in the state. The law goes into effect Jan. 1, 2015.
