Alabama Will Become 47th Dtc Wine State On August 1
Wine manufacturers will be able to ship wine directly to Alabama residents beginning August 1, 2021. At that point, Mississippi and Utah will be the only two states in the nation still banning direct-to-consumer wine shipments for off-site sales.
The change is due to the enactment of House Bill 437, which Governor Kay Ivey signed May 13, 2021. She praised lawmakers for putting together a “good clean bill” and said, “We are moving Alabama with the times.” Earlier this year, the governor signed a bill authorizing the manufacturers, restaurants, and retailers to deliver alcohol directly to customers, and another allowing wineries to sell directly to consumers at special events.
In addition to authorizing direct-to-consumer shipments, the measure maintains the uniform three-tier system of control over the sale, purchase, taxation, transportation, manufacture, consumption, and possession of alcoholic beverages in the state. To that end, the new law:
- Creates a licensing procedure for direct wine shippers and wine fulfillment centers
- Establishes reporting requirements
- Regulates franchise agreements between wine suppliers and wholesalers
- Requires licensed importers and wine manufacturers to enter into exclusive franchise agreements with wholesalers

House Passes Bill Legalizing Direct Shipments Of Wine To Consumers
The Alabama House of Representatives voted in favor of a bill Thursday that would allow consumers to order wine and have it shipped to their residences.
House Bill 350 is sponsored by State Rep. Terri Collins, R-Decatur.
The bill would allow a licensed wine manufacturer to purchase a direct shipper license from the Alabama Alcoholic Beverage Control Board.
Shipping wine directly to a consumer without the direct shipper permit would be a class C misdemeanor for the shipper and the delivery service carrier if they had knowledge that the shipper did not have a valid direct shipper license from ABC.
The cost to apply for the direct shipper license is $200. The annual renewal fee will be $100 a year, and the shipper may not ship to any address that has an ABC license. Purchase of a direct shipper license means consenting to ABC Board authority and jurisdiction, collecting and remitting all applicable sales and use taxes to the Alabama Department of Revenue and accepting that if there is any future litigation, it will be in the Alabama court system.
This applies only to wine, Collins said.
State Rep. Chris Pringle, R-Mobile, offered an amendment that would exempt wines with an existing distributor network in the state.
At Collins urging, the body tabled Pringles amendment.
HB350 now goes to the Alabama Senate for their consideration.

Alabama Alcohol Delivery Bill Signed Law Goes Into Effect Oct 1
Gov. Kay Ivey has signed a bill allowing delivery of beer, wine and liquor in the state, the latest in a series of moves loosening Alabama’s once-strict alcohol laws.
The bill, sponsored by Sen. Jabo Waggoner, R-Vestavia Hills, will allow licensed retailers and restaurants to deliver limited amounts of alcohol to customers.
Beer delivery would be limited to the equivalent of 120 12-ounce beer containers per customer per day . Wine delivery would be limited to 12 750-mL bottles per customer per day. Liquor deliveries would be limited to 9,000 mL per customer for off-premises retailers, and 375 mL for restaurants.
Deliveries would be limited to people 21 and older. Payments would have to be processed before delivery could take place.
The state would charge a $100 fee to apply for a delivery license, and a license fee of $250. Restaurants could only deliver liquor in connection with a meal.
The bill goes into effect on Oct. 1.
