As indicated, some states have loosened up their restrictive direct shipping laws with the dawn of the new millennium. Unless direct shipments are prohibited or limited to on-site orders, the wineries usually need a Direct Shippers Permit. They might also need to register at the state, submit reports, or file for in-state tax.

The catch was to change or, at least, amend the three-tier system which had been in effect since after the Prohibition. This system recognizes three groups in the wine business: wineries , distributors or wholesalers, and retailers. This means a winery sells the label to the wholesaler, who then sells to the retailer, and the retailer was the only one allowed to sell directly to the consumer.

To continue on a positive note, things are much different now. A lot of states allow direct shipping and sales from the winery to a consumer. As a rule, the wineries and required to obtain proper in-state and/or out-of-state licenses as well as the Direct Shippers Permit. However, the regulations dont stop there.

Some states, such as Ohio and New Jersey, allow direct shipments to small scale and boutique wineries only. The annual production limit is 250,000 per year for these two states, but it can be much lower than that. For example, Arizona puts a 20,000-gallon limit on the annual winery production.

Will Estate Wine Clubs Go Out Of Business

Probably not. Because laws make it much easier for wineries to obtain DTC shipping licenses, consumers in most states shouldnt have issues with participating in winery-run wine clubs or purchasing wine to be shipped directly from a winery, both online and in person.

However, wineries typically have to apply and pay for licenses in each state to which they would like to ship, so Koral cautions that not all wineries may want to go through the effort of getting licensed in all 42 DTC states.

Selecting A Delivery Date

What About Independent Wine Clubs

Wine clubs that are not run by wineries, such as the Wall Street Journal Wine Club, Wine Awesomeness, and International Wine of the Month Club, will be affected differently based on how they operate.

Wine clubs that source juice from producers and then bottle it under their own labels can technically apply for a winery shipping license. Alternatively, wine clubs might partner with local retailers or operate local warehouses to fulfill orders, rather than shipping them across state lines.

While there are legal ways for independent wine clubs to operate, these businesses are far more likely to be affected by stricter shipping regulations.

Wine clubs must understand the requirements which are constantly changing otherwise, they risk acting in non-compliance without even knowing until they are caught, Koral says. Though we cannot condone it, there are always some out there that do understand and are still willing to risk violating laws.

Of the wine clubs that VinePair reached out to, Logan Lee, CEO of Wine Awesomeness, noted that its members will not be affected, while Wine Access declined to comment.

New York Has Additional Regulations

How To Ship Alcohol In

Shipping alcohol in-state is the simplest alcohol shipping method but is still convoluted and confusing.

Since you wont be crossing state lines, youll only need to meet the alcohol shipping requirements of the state youre located in. However, you will need to be familiar with the local city laws for the different towns and municipalities in your state. Luckily, alcohol distributors should already be familiar with their local laws regarding alcohol production, distribution, and sales.

Consumers can also use one of the many alcohol e-commerce and delivery app companies such as Drizly or WineDirect to order alcohol directly to their home or to send beer, wine, or spirits to a friend.

We ship wine to most states, though there are still some states that prohibit retailers from shipping wine in their state. We operate multiple warehouses around the country to comply with state laws. To determine if Wine.com ships to your state, use the drop-down menu at the top of the page to select your state. This will ensure you see correct inventory and pricing for your area. Direct-to-Consumer alcohol shipping is governed by individual state regulations, and any person or business looking to legally ship wine needs a DTC license. For most alcohol retailers, the license is covered by their off-premise wine sales licenses. A California retailer, for example, can generally legally ship wine to residents of California.

If an out-of-state entity wants to obtain a license to legally ship wine to another state, however, it must apply for a separate, specific DTC license.

According to Alex Koral, industry relations advisor for ShipCompliant, a company that works with wineries to facilitate compliance, there are currently 42 states that offer out-of-state entities licenses to ship DTC in their states. Residents of Utah, Oklahoma, Delaware, Alabama, Mississippi, and Kentucky may not receive any DTC wine shipments, for the most part in Utah, non-compliance is actually a felony.

The Future Of The Three

As the economy continues to reopen, producers, restaurants, retailers, and bars are hoping many of these temporary measures are made permanent. Delivery is a rising tide for the industry, says Jake Hegeman, WSWAs assistant general counsel, legal and regulatory. Eleven states have proposed legislation to extend or make permanent their temporary expansions on takeout and delivery of orders by restaurants, bars, retailers, or distilleries. Our major focus is ensuring that there be well-thought-out, regulated, but robust consumer delivery, says Hegeman. Consumers love convenience, so the more access they have to new and different brands, the more sales will increase for small producers.

Many craft distilleries would like to see DTC shipping expanded. The American Craft Spirits Association recently all governors and state regulators to provide regulatory relief, allowing for electronic, contactless sales, and fulfillment through third-party carriers. Virginia, California, Oregon, Maryland, and Washington now allow distilleries to deliver to their in-state customers. DTC would allow craft spirits businesses to grow and develop by allowing them to connect directly with their customers in the same manner as wineries.

There is a series of cases pending in eight states challenging laws that allow in-state retailers to ship alcohol to residents, while prohibiting out-of-state retailers from doing so. It remains to be seen where courts will come out on this issue.

Will Digital Retailers Be Affected

Retailers like Wine.com and national retail chains like Total Wine & More are not typically affected by DTC shipping restrictions because they have considerable resources. Total Wine & More, for instance, has brick-and-mortar stores across the U.S., all of which have in-state sales licenses with which they can ship wine orders. Online retailers without physical locations may have the ability to be present in states that do not allow DTC retailer shipping to get around these barriers, through local warehouses or retail partners.

We are licensed and pay sales and excise taxes in the states where we need to, Rich Bergsund, CEO of Wine.com, says. This includes operating our own local warehouses which carry retail licenses just like a store in states where that is necessary. Bergsund stresses that these changes will not effect Wine.com consumers.

Unfortunately, smaller, specialty retailers typically cannot afford to operate local warehouses to get wines across state lines.

Other wine sales sites, like Vivinos Marketplace, merely act as an intermediary between consumers and local retailers, so consumers shouldnt have an issue using these types of sites. However, wine lovers should pay attention to the retailers to which they are directed even if a wine shop in New Jersey is just a few miles away, a Manhattan-dweller is not explicitly allowed to purchase wine and ship it into New York.

Why is that? When Prohibition ended with the 21st Amendment, it gave states the power to regulate and set their own laws on the sale of alcoholic beverages in their states.

  • An adult that is 21 or older must sign for the package

You’ve fallen in love with a Bordeaux produced at a small French vineyard, and you can’t imagine life without this fruity concoction. Unluckily for you, however, “once you’re changing countries, gets exponentially more difficult,” says Weinberg. First, Weinberg advises, you will have to “make sure the product can be legally shipped into the destination without a permit.” You can check this guide to see your state’s individual regulations. If you don’t, your “product could be seized, quarantined, or destroyed,” warns Weinberg. And no one wants that, do they? Shipping out of the U.S. into another country will require you to brush up on state and federal export rules and the import rules of whichever country you’re sending it to . Good luck. Once again, it’s probably best to go through a retailer or distributor.

Weinberg also recommends that you confirm with the retailer or distributor if any taxes or duties need to be paid on the product you intend to ship. If so, they should be able to advise you on how to pay them, and how much they will cost you. Lastly, “purchase from a reputable dealer who knows the ins and outs of laws, and ideally has experience shipping to your destination of choice,” Weinberg advises.

In short, as much as you might like to personally pick up, wrap and send a bottle of booze as a gift, this is one task better left to professionals.

When your booze crosses state borders, “you need to consider the laws for both the shipping state and the receiving state,” says Weinberg. So, for example, if you’d like to send a bottle of wine from a visit along Pennsylvania’s wine trail to a relative in Mississippi, don’t waste your time or your money. While it’s perfectly legal to mail wine from this northern state, it’s also perfectly illegal to receive wine shipments in Mississippi. In other words, Mississippi is not a reciprocal state, a state in which you can receive alcohol shipments from other states or countries, explains Lekkala. Of course, there’s an easy way around these convoluted laws, too. Mostthough not allalcohol that can be purchased in one state can be found somewhere in another, so if you’re dying to ship your brother a new brew, hit the web first to see if you can find a retailer in his state that carries the beverage, recommends Lekkala. It will be much easier to provide a credit card number over the phone than try to send that brew between states. “Even state-controlled stores realize they’re losing business to other states and improving the range of inventories they’re carrying,” Lekkala says.

How To Mail Alcohol Out

When you cross state lines, the shipment of alcohol becomes more difficult. That its because you now must meet the requirements and regulations in both the state youre shipping from and the state youre shipping to.

There is a loophole that helps consumers ship beer, liquor, and wine to other states if that other state permits the shipment of alcohol to consumers. Instead of shipping a bottle from your state to their state, simply find a retailer based in the state youre shipping to and order it from that retailer. That way the retailer wont need to cross state lines and only meet the rules of their states alcohol regulation board.
