Wineries producing less than 270,000 liters per year may ship up to 54 liters in total per individual per year in Tennessee. Larger-scale wineries are limited to shipping no more than 27 liters in total per individual per year. All wineries are also limited to no more than nine liters per individual per month.

Hawaii imposes a sales tax on all shipments of wine sold into the state, with a state rate of 4% and local rates ranging from 0-0.5%. However, Hawaii further states that the tax revenue collected from customers is itself part of the basis for the sale, meaning the General Excise Tax must also be assessed on all such customer collected taxes.

Colorado does not specifically impose sales tax burdens on DtC shippers. However, any DtC shipper with nexus in the state has a general sales tax liability in the state. Colorado’s state sales tax rate is 2.9%, with additional local rates ranging from 0-8.3%. Remote sellers are only obligated to collect and remit state-administered taxes in Colorado.

So, for example, if you’d like to send a bottle of wine from a visit along Pennsylvania’s wine trail to a relative in Mississippi, don’t waste your time or your money. While it’s perfectly legal to mail wine from this northern state, it’s also perfectly illegal to receive wine shipments in Mississippi. In other words, Mississippi is not a reciprocal state, a state in which you can receive alcohol shipments from other states or countries, explains Lekkala. Can you — legally — ship wine to your friends for the holidays? Just like last year, it depends on where they live.
The U.S. Supreme Court didn’t exactly force open a door for direct shipping of wine with its May ruling on the issue. Instead, it nudged 50 different doors: some swung open, some slammed shut and many remain confusingly ajar.
Wine shipping regulations continue to vary by state. Moreover, while several states created new laws this year that allow California wineries to ship directly to their residents, some added regulations to discourage it.
“Some states, it’s just not worth it,” says Jennifer Tensley, director of operations for Tensley Wines in Santa Barbara County. “The paperwork for Texas and New York isn’t too difficult. Connecticut is like a book. Plus, they want quarterly reporting. We’re not shipping to Connecticut.”
Now here’s a different question: Can you ship wine to your friends, regardless of where in the United States they live?
The answer seems to be yes. As an experiment, two bottles of wine each were shipped last week to people in Florida, New Jersey and Tennessee — all states to which such shipping is not completely legal.
No one rejected the packages, and the wines arrived without incident in all three states.

UPS spokesman Norman Black cautions that if a law was broken, the sender is the one responsible — not the delivery driver.
How To Mail Alcohol Out
When you cross state lines, the shipment of alcohol becomes more difficult. That its because you now must meet the requirements and regulations in both the state youre shipping from and the state youre shipping to.
There is a loophole that helps consumers ship beer, liquor, and wine to other states if that other state permits the shipment of alcohol to consumers. Yes, all brands being sold into Connecticut must by registered with the state prior to sale. Brand registrations cost $200 per brand and are valid for three years. Any brands that have previously been registered for distribution through Connecticut wholesalers do not need to be re-registered for DtC shipping and vice versa.

Is It All Good News
A 2017 New York Times article sent nation-wide ripples across the wine connoisseur community with a conclusion that only 14 states allowed for cross-state wine shipping. However, the legislators have amended some of the regulations by late 2018.
For example, direct shipping has been legal in Oklahoma since October 2018. The carriers and wineries need to follow in-state reporting procedures and pay special taxes. The New York state legislation is unique in that it requires a winerys home state to have similar direct shipping laws as the state of New York itself.

What Excise Tax Rates Are Applied To Dtc Shipments In Ohio
Ohio assess a tax on all wine sold in the state at a rate of $0.30 per gallon on wines with an ABV of 14% or less, $0.98 per gallon on wines with an ABV greater than 14%, and $1.48 on all sparkling wines. In addition there is a $0.02 Grape Fund due, and sales to Cuyahoga County are taxed an additional $0.32 per gallon. However, wineries producing less than 500,000 gallons per year are exempted from the standard excise taxes, and will only owe the $0.02 Grape Fund and Cuyahoga taxes.
